헤이그 비스비 규칙은 운송계약의 명세에 대한 정보를 제공할 의무와 위험화물에 대한 의무만을 송하인에게 부과하고 있다. 컨테이너 운송이 급격히 증대함에 따라 운송물 사고도 증가하였다. 이것은 운송인은 컨테이너안에 적재된 운송물의 내용을 파악할 수 없기 때문이다. 현대 포츈호 사고는 좋은 예이다. 컨테이너 안에 적재된 화물에 대한 적절한 통지가 없다면 운송인의 안전한 운송은 보장되지 않는다. 새로운 로테르담 규칙은 송하인에게 몇가지 새로운 의무를 부과한다. 송하인은 운송인에게 운송에 적합하도록 준비된 상태로 운송물을 인도하여야 한다. 또한, 송하인은 운송물에 대하여 적절한 관리가 되도록 운송인에게 이에 관한 정보를 제공하여야 한다. 송하인은 자신의 이러한 의무의 위반에 의한 운송물 사고에 대하여 책임을 부담한다. 송하인이 계약명세에 대한 정보를 제공할 의무에 위반하거나 위험화물의 성질에 대하여 운송인에게 고지하지 않으면 손해에 대하여 무과실책임을 부담한다. 이러한 송하인의 의무와 책임은 강행규정의 적용을 받기 때문에 약정으로서 이를 더 감면할 수 없다. 이 점은 헤이그 비스비 규칙 및 우리 상법과 결정적으로 차이가 나는 점이다. 헤이그 비스비 규칙에 비하여 로테르담 규칙은 송하인에게 좀 더 많은 의무를 부과하고 있다. 이 점에서 운송인과 송하인의 보호는 헤이그 비스비 규칙에 비하여 더 균형잡혔다고 할 수 있다.
The Hague-Visby Rules impose only two obligation and liability upon the shipper in relation to information for the contract particulars and dangerous cargo. As the container transportation has increased sharply, the cargo accident also increased. It was because the carrier could not find out the content of the cargo stowed in the container. The explosion case of M/V Hyundai Fortune was one of good example. Without giving proper notice of the cargo loaded in the container, the safe carriage is not secured by the carrier. The new Rotterdam Rules impose several new obligation upon the shipper. The shipper should provide cargo ready for carriage to the carrier. In addition, the shipper should provide information for proper handling of the cargo to the carrier. The shipper is liable for the cargo damages caused by the breach of the obligation of the shipper. If the shipper breach the obligation to provide information for compilation of contract particulars, and of informing the carrier of the dangerous nature or character of the goods, the shipper is strictly liable for the damages. The derogation from these obligation and liability is not allowed under the Rotterdam Rules, which is different from that of the Hague-Visby Rules and Korean Commercial Code. The obligation of the shipper under the Rotterdam Rules are more balanced than in the Hague-Visby Rules.
