중국통상법은 한중간의 교역 증가에 따른 무역마찰의 증가를 고려해 볼 때 철저히 연구되어야 하는 분야 가운데 하나이다. 하지만 중국통상법에 대한 높은 관심에 비해 중국통상법에 관한 정확한 개념이나 범위와 같은 기본적인 연구는 사실상 많지 않으며, 이미 발표된 연구 논문들도 내용이 일률적이고 단편적임을 지적하지 않을 수 없다. 뿐만 아니라 중국통상법에 관한 그 동안의 연구는 급변하는 중국대외무역관리제도의 최신 동향을 반영하지 못하고 있다. 이제 중국통상법에 관한 연구는 양적, 질적 제고가 모두 필요한 시기이며, 본고는 향후 중국통상법의 교육과 접근방법에 중점을 두고 중국통상법에 대한 기본적이면서도 총괄적인 내용을 다루고자 한다. 본고는 먼저 중국통상법의 개념 및 그 내용과 범위를 새로이 정립하였다. 중국통상법과 유사한 법의 경계가 모호하여, 중국통상법 이해에 걸림돌이 될 수 있기에 중국통상법에 포함되는 내용과 구조를 명확히 함은 나무가 아닌 숲을 보는데 도움이 될 것이다. 다음으로 1994년의 (구) 대외무역법을 전면 개정한 중국 무역 관련 기본법인 중국대외무역법 이외에도 중국 대외무역관련제도의 법원(法源)이 되는 기타 법률, 행정법규와 국제조약을 알아보고, 중국대외무역관리제도의 기본구조 및 법률체계를 살펴보았다. WTO 가입 후 중국 대외무역관리법제의 큰 변화 방향과 흐름을 파악하는 것은 구체적인 법규를 교육하는 것보다 우선되어야 하기 때문이다. 또한 중국통상법에 대한 관심이 높아짐에 따라 중국통상법 교육과 그 접근방법에 대해서도 연구될 필요가 있다. 왜냐하면 중국통상법도 법이라는 테두리 안에서는 다른 법학 분야와 연구방법이 대동소이하나 중국이라는 정치적·경제적 특색이 있기 때문에 접근하는 방법은 다소 차이가 있어야 하기 때문이다.

Chinese Trade Law is one of parts which is thoroughly studied as considered increasing trade between Korea and China. Compared to the high interest in Chinese Trade Law, it has been true that there are not enough studies on basic areas such as exact definition and boundaries of Chinese Trade Law, and the studies which have been already studied are so fragmentary and uniform. In addition to that, the studies which have been already studied do not include recent changed and changing regime of Chinese Trade Law. It is highly time needed to improve studies of Chinese Trade Law quantitatively and qualitatively. The paper, hence, focuses on a way of approach to the Chinese Trade Law and its teaching, which is not only basic but also general issues of Chinese Trade Law, and points out the problems of current teaching and suggests the direction of teaching Chinese Trade Law. The paper, first of all, formed a wide definition, contents and scope of Chinese Trade Law. It will help to understand by defining clearly contents and structure included Chinese Trade Law because Chinese Trade Law and its adjacent law areas have not been distinct. Then, the paper explains basic structure and regime of current Chinese Trade Law by showing laws, regulations and treaties which are sources of regime of Chinese Trade Law including Chinese Foreign Trade Law that is a basic law of trade related law. Because figuring out direction and stream of Chinese Trade Law after entering into WTO should be preferred to teach specific regulations. As growing interest in Chinese Trade Law, a way of approach to the Chinese Trade Law and its Teaching should be studied. Chinese Trade Law is close to the other law areas, but China has its own political and economic characteristics, hence the way of teaching and approaching should be different from others.
