감사원은 헌법상 기관이며 헌법에서 규정하고 있으므로 감사원의 독립성을 제고하기 위한 감사원법의 개정은 결국 개헌논의에 연결될 수 밖에 없을 것이다. 본고는 이러한 점에 착안하여 감사원법이 감사원의 독립성 확보와 관련하여 현행 법제도하에서 어떠한 문제점을 가지고 있으며, 차제에 헌법이 개정될 때에 어떻게 개정되는 것이 바람직한가를 논의함에 있다. 우리 헌법의 개정논의와 더불어 감사원과 관련하여 논의되고 있는 핵심적인 사항은 감사원이 어떤 국가기관에 소속되는 것이 감사원의 독립성 확보를 위해 가장 좋은 방안이 될 수 있을지와, 감사원의 독립성을 제고하기 위해서는 특정한 정부형태가 전제되어야 하는 것인지인데 이에 대해서는 현재 주요국가에서 운영되고 있는 감사기관제도를 비교 고찰함으로써 주요한 시사점을 얻을 수 있을 것이다. 그리하여 감사원의 독립성확보를 위한 비교법적 고찰을 통해 다음과 같은 결론이 도출된다. 첫째로 감사원의 독립성을 확보하기 위해 정부형태와 감사원 소속과의 관계는 필연적으로 관련이 없다는 점이다. 둘째로 의회가 민주적으로 통제하고 감시하여야 하는 재정민주주의의 원칙에 가장 충실한 감사원의 소속형태는 의회에 소속되는 유형이지만, 그 직무상 독립을 법률로 보장하는 등으로 회계감사기관의 독립성을 제고하는 것이 현대적인 추세이다. 셋째로 한국적 정치상황 속에서 감사원을 의회의 소속으로 하면 많은 문제점이 노출될 수 있다는 점이다. 감사원이 자칫 여야의 정쟁의 소용돌이 속에 갇혀서 감사원 본연의 기능을 수행할 수 없을 가능성이 크다. 이상과 같은 논의의 결과 감사원의 독립성을 제고할 수 있는 가장 좋은 방안은 감사원을 행정부 및 입법부로부터 독립하여 독자적인 헌법기관으로 설치하는 것이다. 이러한 예를 우리는 프랑스, 독일 및 EU의 예에서 잘 살펴보았다. 그러나 이러한 방안을 실현하기 위해서는 관련 헌법조항의 개정이 뒤따라야 할 것이며 아울러 감사제도의 합리화도 추진되어야 할 것이다.

The Board of Audit and Inspection is a constitutional institution and it's position is written in Korean Constitution. Therefore, the effort enhancing the independence of it is to be connected to revise the Constitution. This paper calls attention to comparative legal approach to get a implications deduction for the independence of the Board of Audit. Through this method, the conclusion is drawn as follows. Firstly, it is not the corelation between the form of government and the attachment of the Board to enhance the independence of it. Secondly, the attachment form of audit institute corresponding financial democracy is under the national assembly. Thirdly, if the Board of Audit and Inspection would be under the National Assembly, many problems could happen. It would be much possible that it can't fulfill its role while being caught in a political whirlpool. Finally, it is the most effective method to enhance independence of the Board of Audit and Inspection that the Board would be an independent constitutional institution following the example of the French's or German's. But for this end, it should be followed to revise the Constitution and to rationalize the Audit system.
