이 글은 국가방위교육법 입법사례를 통해 미국의 연방정부 권한이 증가된 배경과 요 인을 밝히는 것이 목적이다. 국가방위교육법은 1955-6년, 1957년, 1958년 세 차례에 걸쳐 제안되었다. 이 글은 법안이 처음 제안된 1955년부터 최종 승인된 1958년까지의 세 차례 입법과정을 각각 다룬다. 이 글에서 주장하려는 바는 연방정부의 권한 확대가 국가 위기라는 외부 환경이나 집권정당의 정책성향의 결과로 파악하기보다는 연방정부 와 주정부에 연관된 각 행위자의 역할에 주목하여 설명한다. 이 글은 입법과정에서 행 위자들 간의 상호작용이라는 기능적이고 제도적 측면에 상당부분 의존하고 있다는 점을 보여준다. 이 글은 세 차례에 걸친 입법과정 속에서 쟁점이 되었던 연방 시스템과 권한 의 영역과 수단에 논의의 초점이 맞추어져 있다. 국가방위교육법 입법은 주정부의 권한이었던 교육 분야, 특히 학자금 등의 세부적인 항목에 대한 지원에 있어 연방정부의 결정권이 커진다는 점에서 연방정부의 권한의 확 대를 의미한다. 법안의 성격이 지속적으로 변화하면서 제정된 국가방위교육법은 연방정부 권한 강화과정이 한 정부 수준의 소수 행위자 주도로 인한 것이 아니며 그 과정에 연 방정부만 존재하는 것이 아닌 주정부 행위자들을 포함한 정책결정의 참여자들 간의 상 호작용을 통한 결과임을 알 수 있다. 또한 국가방위교육법 제정과정을 통한 연방정부의 권한 확대는 기존에 논의에서 제시되었던 국가적 위기상황에 기반을 둔 설명방식이 지 나치게 단순한 한계점을 보인다는 것을 명확히 보여주고 있다.
With the legislation of the National Defense Education Act of 1958, the federal government of the United States began to intervene in higher education system. The regulations restraining independent acquirement of knowledge were made on the basis of NDEA. At the same time the intervention of the government brought great deal of financial support in the research field. This act successfully carried out its purpose of enhancing national security, but also had a side effect of the government gaining higher control of selecting which research topic to make funding to. Hence, since the legislation of the NDEA, the federal government drastically gained power over education system.The purpose of this research is to analyze the legislative process that consolidates the authority of the federal government, focusing on the federal-state government actor that takes part in the federalism as to enhance the understanding of federalism of the United States. The authority shift of the federal government can be explained by examining the internal legislative process in the case of NDEA. This thesis intends to confirm that the internal actors played significant role in the enacting process of NDEA. On top of this, I emphasize the fact that the interaction between the federal-state government is crucial in in-depth understanding of the U.S. federal system.
