한국의 ‘경범죄처벌법’은 일본의 ‘경찰국가적’(the police state) 제도의 하나로서 등장한 ‘경찰범처벌령’에 기초한 것으로, 조선에 ‘경찰범처벌규칙’으로 확산된 것이다. 1910년 8월22일에 한일합병조약의 체결로 인하여, 일본제도의 조선에 대한 침략이 시작된 것이다. 무방비 상태에 놓인 조선은 ‘완충’(buffing)할 만한 어떠한 장치도 없이, 일본제도의 침투에 속수무책이었던 것이다. 즉, 저항 할 수 있는 ‘완충보드’(buffing board)가 작동 될 여지는 없었다. 이러한 제도적 투영은 ‘강압력에 의한 동형화’(coercive isomorphism)’의 하나로 이해되어 질 수 있었다. 일본의 제도는 미군정기에 이르러서도, 식민시대의 제도가 모방의 과정을 통해 ‘동형화(isomorphism)’ 된다. 정부수립 후, 한국도 일제와 미군정이 한국 민중에게 행한 ‘억압의 성공사례’를 받아들여, 과거의 제도를 채택하게 된다. 즉, 모방의 과정을 통해 기존의 제도를 ‘동형화’하기에 이른 것이다. 특히, ‘군사권위주의적 정권’에서는 사회적 억압의 수단으로서, 경범죄의 범죄유형 이 새로이 추가되 는 등, 개인의 생활에 대한 경찰권 개입의 근거가 지속적으로 확장되어 왔다. 그러나, ‘민주화 시기’에 이르러, 악법으로 불리는 독소조항이 삭제되는 등의 진전도 있었다. 끝으로, 제도생성과 변화의 ‘아이디어’는 ‘목적’과 관계되어 진다는 것이다. 일본의 경찰국가적 아이디어는 민중에 대한 억압적 제도로 이행하였다. 그 결과, ‘경범죄처벌’은 ‘헌병통치’의 수단으로 전락하게 된 것이다. 이러한 이행의 경로는 ‘군사권위주의적 정권’을 비롯한 민주화정권에서 조차도 그 제도의 성분으로 발견된다.


Korea's ‘Minor Offenses Act' based on ‘Gyeongchalbeom cheobeolryeong’ which appeared as one the institutions of Japan's police state expanded to ‘Gyeongchalbeom cheobeol gyuchik’ in the Chosun era. Signing ‘Hanil hapbyeong joyak’ on August 22nd, 1910 triggered Japanese institutions' invasion into Chosun. Chosun which had few buffing devices was helpless before the invasion of Japanese institutions. That is, there was no room for ‘buffing board' working as resistance device. This projection of institutions can be interpreted as one of 'coercive isomorphism.' Even during the period of U.S. military government in Korea, institutions in the era of Japanese occupation of Korea maintained their forms through mimetic process. After the establishment of the Korean government, Korea adopted the institutions of the past, accepting successful cases of suppression Japan and U.S. military government imposed on Korean people. That is, institutions of the past maintained their forms through the mimetic process. Especially, under the authoritarian regime, the basis for police authority's intervention into individual life, including the addition of the types of minor crimes as a means of social suppression, has continuously expanded. However, during the era of democratization, there have been some progresses like the deletion of poisonous provision called evil law. Finally, the idea of ‘institution building’ and ‘change’ is related to the aim. The idea of Japan's police state was implemented as an institution to impose suppression on people. As a result, ‘Gyeongbeomjoe Cheobeol’ has been reduced to a means of military police's governing. As for the path of such transference, the ingredients of the institution are detected not only in the military regime but also in democratic regime.
