Until now, maternity leave and parental leave have not been discussed as mainstream subjects in the area of labor law and social security law in Korea. However, considering the extremely low birth rate in korea, we have no choice but to review these subjects as a small method even to resolve the serious present problem. If a nation cannot guarantee the reproduction of citizens, it does not deserve to exist. To make an environment where the citizens can reproduct freely, as one useful method, we need to use maternity leave and parental leave well. In this article, the author will analyze and review the various legal aspects surrounding maternity leave and parental leave, the author would try to make an opportunity for deeper consideration about these subjects.
