Because real estate auction has the advantage of buying real estate at the lower price than the present market price, a number of people have been involved in the auction for the purpose of buying their own private house or investment. But the general public involved in the real estate auction have difficulty analyzing the object of real estate for sale and further more have a harder time conduct its title analysis. Especially, the interested parties in real estate auction know that 'the buy shall take over the lien without putting restriction on the period of its establishment or the presence or absence of the opposing power'. And the lienor lowers the selling price by declaring the falsified and exaggerated lien or the lien without the opposing power by abusing it and delays the delivery of real estate, which inflicts much damage.Therefore, this study attempted to investigate the limit of effect of the seizure and mortgage of the lien in real estate auction and define its definition, thereby helping the interested parties make the title analysis and contributing to stabilizing real estate transactions through real estate auction.
