일반적으로 ‘신의’란 ‘상대방의 성실에 대한 신뢰’를 의미하며, ‘성실’이라 함은 ‘의무준수에 관한 무사한 준비’를 말한다. 그러므로 신의칙이란 어떠한 법률관계에 관여한 자는상대방의 정당한 이익을 고려하여 권리를 행사하며 의무를 이행하여야 한다는 원칙을 말한다. 현대사회에 있어서 신의칙은 채권관계 뿐 아니라 물권관계, 가족관계 그리고 공법및 절차법 영역에 있어서도 적용되고 있고, 결국 그 역할 및 기능에 있어서 적극성이 강조되는 원칙 내지 규범으로 변모되고 있다. 특히 신의칙이 민사소송법과 같은 절차법에 적용될 경우에는 실체법인 민법에서 적용되는 것과는 여러 면에서 차이가 있으므로 그 적용의 결과 역시 다른 모습으로 나타나게된다. 민사소송법의 경우는 절차의 형성과 관련된 규범이므로 신의칙은 소송상의 행위가갖는 의미가 절차형성에 미치는 결과와 무관하지 않고 이는 결국 당사자의 진실의무.완전의무 그리고 법원에서의 소송촉진의무와 밀접하게 관련되어 있기 때문이다. 즉 절차법인 민사소송법의 경우는 권리의 발생.변경 등과는 달리 민사소송의 이상을 구현하는 구체적인 절차형성에 초점이 맞춰져 있으므로 그 차이가 있을 수밖에 없고 따라서 신의칙이 갖는 의미와 기능이 실체법의 그것과는 다르다고 하는 사실에 주목하여야 한다.
In general, the words 'good faith' and 'fair dealing' imply, respectively, 'trust on other party's fair dealing' and 'faithful preparation for the fulfillment of a duty'. The duty of good faith and fair dealing doctrine establishes that a party to a legal matter should claim his rights and fulfill his duties in consideration of the other party's interests. In a modern society, the duty of good faith and fair dealing doctrine applies to not only contract law issues but also property law issues, family law issues, public law issues and procedural law issues, and it has become a binding rule. In particular, when the duty of good faith and fair dealing doctrine applies to procedural law issues (e.g., civil procedure issues), the outcomes will be much different than when applied to substantive law issues (e.g., civil law issues) in many ways. This is because the application of the doctrine in civil procedure is closed related to the party's duty of candor, the party's perfect duty and the duty of the court to expedite court proceedings. It should be noted that the implication and function of the duty of good faith and fair dealing doctrine in civil procedure are different from those of substantive laws due to the fact that civil procedure focuses on establishing detailed procedures which materialize the objectives of civil procedure, not establishing binding rules on the creation and modification of rights and duties.
