교육과학기술부는 ‘교권 보호 종합 대책’을 발표(2012.8.28)하였고, 교원지위향상법 개정을 통한 제도보장 사항을 포함한 입법예고(2012.9.27)를 했다. 이 연구는 현재 정부, 국회, 지방의회에서 논란이 되고 있는 교권 보호 법제화의 특징과 관련된 쟁점을 분석하고 그에 따르는 과제를 제시한 것이다. 교권 보호 법제화의 범위와 한계에 대한 판단의 준거로서 교원의 지위에 관한 입법 정신을 헌법과 교육관계법을 중심으로 규명하였다. 이어 현재 진행되고 있는 교권 보호 법제화의 현황 및 실태를 국회의 입법안과 정부의 개정안, 그리고 지방의회의 조례를 중심으로 분석했다. 쟁점으로 교권에 대한 개념 규정의 문제, 입법 체계의 문제, 교권 침해의 판단 기준의 문제, 교권 보호 제도의 실효성 문제, 그리고 학생 인권 보호와의 관계 측면의 문제 관점에서 검토하였다. 결론으로 교권 보호 법제화와 관련된 문제 상황은 독립된 교원지위 기본법의 부재와 교권 개념의 불명확성에서 기인한 것이며, 이를 해소하기 위한 입법정책과 제도 보장의 과제 및 제언을 하였다.
The purpose of this study is to analyze the issues of the protection of Teacher's Right and Authority(hereinafter referred to as TRA) in legislation and propose it's tasks. This article is consisted of five chapter; Preface, The spirit of the Constitution and education law, the bill and bylaw related to TRA, Issues from the TRA in legislation, and conclusion. The Ministry of Education, Science and Technology(MEST) announced the 'Comprehensive Plan for Protection of TRA' in August 2012, and proposed legal amendments related with TRA. The concept of TRA consist of the his freedom of education and social status. The article 31 of Constitution(⑥……, and the status of teachers are determined by law) means the principle of law for the status of teachers. It means that the designated process should be taken when legislature decide or change the status of teachers. And it contains the spirit of the Constitutions to guarantee independence, professionalism, political impartiality of education by ensuring the status of teacher as an educational expert. Also it is acted as a barometer in the legislation of teacher's status and the reform of teacher-policy. Also Education Basic Law declare the eight main points related with teacher and teacher's association(article 14). The Issues from the TRA in legislation can be described as concept of TRA, system of law, criteria of the entrenchment of TRA, effectiveness of protection for TRA, and conflict of the student's human rights. As a conclusion, the cause of the conflict in legislation policy can be said that it comes from the chaos of concept about TRA. And this article proposed some tasks for the protection of TRA in terms of government policy and subsequent research.
