오늘날 우리나라는 우리의 헌법적 가치에 기초한 입법의 방향을 검토하고 중앙정부의 대표기관들의 권한남용과 지방자치의 활성화에 따른 지방의회의원들의 권한남용에 대해서도 진지한 검토가 필요한 한마디로 국가총체적 대표제의 위기시점에 서 있다. 인간이 신이 아니기에 제한적 공간에 제한적 능력하에 활동한다. 그런데 선출직공무원의 경우는 슈퍼맨을 연상시킨다. 특히 우리 헌법상 대표제상 강력한 권한을 가지는 대표기관들이 그에 합당한 의무를 지지 않고 권한남용을 해왔던 헌정사적 검토를 볼 때 이에 대한 국민의 통제는 매우 필요하다고 할 것이다. 그 중에서 가장 강한 권한남용의 사례는 부당한 겸직을 통한 권한남용일 것이다. 특히 선출직은 직무전념의무상 그리고 강력상 권력의 소유로 인하여 권한남용의 우려상 일반 사인보다 더 겸직금지의 필요성이 더 크다고 할 수 있기에 대통령과 국회의원과 지자체장과 지자체의회의원에 대한 겸직금지를 검토하여 보았다. 이에 대해서 주민소환제도를 활용하든지 법률로서 겸직의 허용여부를 명백히 규정하든간에 이에 대한 민주적 통제가 필요하다고 보인다. 특히 겸직하는 업종이 영리이든 비영리이더라도 선거운동에 동원할 수 있기에 겸직을 원칙적으로 금지하는 것이 타당하다는 입법정책적 방향을 제시하였다. 하지만 주민소환제도는 외국의 예에서 볼 때 작동하지 안을 수 있기에 이러한 시점에서 입법으로 국민의 의사에 기초한 합리적인 방향설정을 하고자 하는 것이 진정한 민주주의를 가능하게 하는 법치의 나아갈 방향이자 이 논문의 지향점이다. 새로운 미래지향적 대표기관의 행위의무와 지위에 대한 검토는 매우 중요하다고 보인다.
Today, In Korea, We are currently in overall political crisis when we need serious study of legislative direction considering constitutional value because of representative abuse of central and local power. One of the most serious representative abuse of central and local power is holding multiple personal positions. We are not gods, so we are acting in limited time and space. But representative persons of central and local power act as superman holding multiple personal positions. especially, representative persons containing president and congressman of central and local power need more legislative and political control because they can abuse their power and must concentrate energy and ability on representative role. But in korea, the reality is away from ideal point, so we must make law preventing representative persons from holding multiple personal positions for the interest of people of owner of this country. Of course, to prevent representative persons from holding multiple personal positions, we can use recall system, but recall system can not work in some cases, so we must make law to prevent, clearly and strongly, representative persons from holding multiple personal profit and nonprofit positions. To decide future-oriented direction of representative persons’ duty and position is urgently necessary today in korea.
