통일한반도는 민주주의와 법치주의를 구현하며, 민족의 동질성회복과 북한 지역민의 차별과 소외됨이 없도록 통일이 이루어져야 한다. 이러한 과제들의 해결을 위해서는 무엇보다 경찰행정체제 통합의 법제화 방안이 연구되어야 할 것이다. 이런 점에서 통일독일의 사례는 우리의 경우에 있어 좋은 사례일 것이다. 그리고 이러한 연구를 위해서는 먼저 현행 한반도의 경찰행정체제의 비교연구가 필요하고 실질적으로는 북한의 인민보안부의 구성과 역할, 관련 법률인 인민보안단속법에 대한 검토가 필요할 것이다. 이를 통한 북한 경찰행정체제를 통일이후 어떻게 통합할 것인가에 관한 방안이 연구의 핵심문제일 것이다. 따라서 본고에서는 그 법제화 방안을 통일의 시기별로 나누어서 조기통일 시 ‘북한경찰청의 설립’에 관한 법제화 방안과 점진적 통일 시 ‘북한 경찰행정부의 설립’에 관한 법제화 방안을 제시하여 북한 지역의 경찰행정체제를 통합하도록 하는 법제화 방안의 제정이 필요함을 고찰하여 보았다. 전자는 통일이후의 상황이 남북한을 단일한 경찰행정체제로 관리하는 것이 어려울 정도로 경찰행정수요가 급증한다면, 북한지역을 남한의 경찰행정체제로부터 독립시켜 별도로 관리하기 위해 (가칭)북한경찰청의 설립이 효율적인 통일행정을 위하여 긴요할 것이므로 위 법률의 제정이 필요함을 제시한 것이고, 후자는 점진적 통일의 경우, 통일시점에서 남북 간 이질감과 격차가 크지 않기 때문에 경찰행정수요가 크지 않을것으로 예상하고, 북한지역의 경찰행정의 효율적인 운영을 위하여 (가칭)북한 경찰행정부를 신설하여서 북한 지역의 경찰행정을 통합ㆍ관리하도록 하는 법제화 방안의 제정이 필요함을 제시하여 보았다. 이상과 같은 경찰행정체제 통합의 법제화 방안 등의 연구를 통하여 안정적인 통일한반도를 수립하여야 할 것이다.
The Unified Korea should embody democracy and aim at welfare state. And racial homogeneity should be recovered and integration should be done without discrimination and alienation for North Korean people. To do this, it would be essential to suggest the Legislative plans for the Police Administrative System Integration. We can know that the case of unified German is a very important task for solve Problem in Integration. Above all, The most serious integration challenges in the Unified Korea will be stable establishment of unified nation by integration of the police administrative system. And to do a Study on the Legislative Plans for the Police Administrative System Integration, First, it needs to a comparative study of the current the police administrative system in the Korean Peninsula, a study of the People’s Safety Enforcement Law, the People’s Safety Agency. Through this integration plan, it will be a key issue by a study on the Legislative plans for the Police Administrative System Integration in North Korea. Therefore A plan to foster specialized the Police Administrative System Integration by legislating ‘(temporary name) act for the establishment of the North Korean National Police Agency’ and legislating ‘(temporary name) act for the establishment of the North Korean National Police Administration’ should be considered. And through a Study on the Legislative Plans for the Police Administrative System Integration, It should be to establish a stable the Unified Korean Peninsula.
