이 글은 인권 문제를 다문화사회의 구체적 사례에서 접근하는 것이 아니라 문제를 이해하고 해결책을 제시하기 위한 관점 확보를 목표로 하는 ‘발견술적 시도’(a heuristic attempt)를 담고 있다. 따라서 문화상대주의와 보편주의사이에서 표류하고 있는 ‘문제로서 인권’이 중심적인 주제이다. 이론적 논의는 때로 진부해보일 수 있지만 인권 신장의 방향을 제시할 수 있다는 점에서 중요하다. 우리의 짧은 다문화사회의 역사 속에서 인권의 문제는 단순히 법적·제도적 문제일 뿐만 아니라 또한 의식의 문제이기도 하다. 이것은 인권과 연관된 다문화교육의 중요성을 말해주며, 이 교육의 목표가 바로 인권에 대한 정확한 이해와 실천이라 할 수 있다. 이 글은 먼저 보편주의와 문화상대주의의 대립 속에서 인권 문제를 조명함으로써, ‘인권의 원천’에 대한 올바른 이해를 도모하고자 한다. 그 다음 ‘문화상대주의의 관점에서의 인권’을 월리엄 J. 탤벗의 시각에 따라 집중적으로 고찰하고자 한다. 그는 문화상대주의의 입장에서도 삶의 경험과 타자들과의 교감, 즉 ‘감정이입적 이해력’을 통해 보편적인 도덕적 판단에 도달할 수 있다고 전망한다. 물론 이 판단이 추후적으로 수정될 가능성은 전제되어진다. 탤벗은 ‘삶속에서의 실험’(experiments in living)이라는 슬로건을 통해 이론적이며 인위적인 ‘보편적 기준’이 아니라, 주어진 여건과 상황에 부합하는 공존과 관용의 가능성을 끊임없이 모색하는 것이 실천적 차원에서의 인권 문제의 해결에 기여할 수 있다고 역설한다. 이 러한 관점은 우리나라의 인권문제, 특히 다문화사회와 연관된 현상에 접근하는 좋은 이론적 본보기가 되리라 기대한다.
This paper does not approach to the specific examples of concrete problems of multi-cultural society (ex. human rights of international marriage migrant women or guest workers) but it is a heuristic attempt that aims to secure a perspective to understand those problems and to offer a solution. Therefore, 'human rights as problematic' that drifts between cultural relativism and universalism is the central topic. This kind of theoretical approach may seem hackneyed when considering the sharp problematic situation that surrounds human rights; however, it is important in that it can adduce a direction for the increase of human rights within a concrete domain in the future. We can know that even in the short history of multi-cultural society, the issue of human rights is not only legal and institutional problem but also an ethical problem. This shows the importance of multi-cultural education associated with human rights, and that the purposes of this education are the accurate understanding and practice of human rights. First of all, considering the conflict between universalism and cultural relativism, this paper aims for the proper understanding of the origin of human rights by tracking the history of human rights. Then this paper intensively considers 'human rights from the perspective of cultural relativism from the view point of William J. Talbott. He prospects that we can reach universal and ethical judgement through our life experiences and internal communion (emphatic understanding) with other people even from the position of cultural relativism. Of course, he is open to the possibility of this judgement being edited. He insists that it is not the theoretical and artificial 'universal standard' but constantly seeking the possibility of coexistence and tolerance that accord with the given conditions and situation is what contributes to the solution of human rights in practical dimension through the slogan of 'experiments in living.' He emphasizes that this course of seeking represents the advance of humanity. Lastly, looking at the impact of this kind of discussion on our multi-cultural society will conclude this paper.
