Care workers at home, like workers generally, enjoy fair terms of employment as well as decent working conditions and, if they reside in the household, decent working conditions and shall be protected under the Fair Labor Standards Act(FLSA). However it is difficult to be protected under the FLSA because domestic workers are ruled out from the application of the FLSA. Considering that domestic work continues to be undervalued and invisible and is mainly carried out by women, and recalling that international labour Conventions and Recommendations apply to all workers, International Labor Organization adopts the Convention concerning Decent Work for Domestic Workers on 16 June 2011. Recognizing the special conditions under which care work at home is carried out that make it desirable to supplement the general standards specific to domestic workers so as to enable them to enjoy their basic terms of employment. Moreover the government should its best for the protection of lives and safety of care workers, because every domestic workers has the right to a safe and healthy working environment. This study maintains that the Industrial Accident Compensation Insurance Act should be applied for the workers for care services at home. Also this study emphasizes the need of written contracts between the employer and the care workers at home to ensure that domestic workers are informed of their terms and conditions of employment in an appropriate, verifiable and easily understandable manner and preferably.
