In terms of functions, the meaning of trials in a modern society has changed from a strike to claim rights to a process for delivering results in accordance with legal procedures. This has led us to seek alternative ways of resolving legal matters and alternative dispute resolution organizations. The objectives of civil procedure should be understood from multiple perspectives including protection of rights, contribution to dispute resolution, procedural due process in practice and embodiment of laws etc.. If they are understood in such a way, the right to a trial should have a broad definition. In other words, the right to a trial should include rights to all private civil actions related to a civil dispute. Since the objectives of a civil trial are ultimately related to the judge’s decision, it is required that a new approach to the functions and implications of the civil trial be introduced. Theoretical discussions on the modern implications of civil trials have focused on justification for the trials. The justification should be found on the ground whether the parties to the case had given equal opportunities in arguing against each other and providing evidences, not whether the judge had been given full authority to determine the case and deliver the final decision.
