지금 우리사회는 하루가 멀다 하고 범죄가 연일 발생하고 있다. 이 또한 나날이 폭력화⋅전문화되어 가고 있다. 일반적으로 피해자 없는 범죄는 없다 할 것이다. 이에 범죄발생량이 증가함에 따라 그 피해자의 수 또한 병행적으로 증가하기 마련이다. 이에 과거에는 범죄발생과 관련하여 ‘범죄자’에 초점이 맞추어져 연구가 이루어졌으나 최근에는 ‘피해자’에 대한 관심의 증폭으로‘피해자학’에 대한 연구도 활발히 이루어지고 있는 형편이며, 그 내용의 핵심은 피해자지원이다. 이는 이미 발생한 범죄피해자에 대하여 관련기관이 얼마나 적극적으로 피해자지원에 나서느냐에따라 피해회복의 속도와 범죄피해자가 국가가 또는 피해지원관련기관으로부터 내가 보호받고 있다는 안정감을 줄 수 있기 때문이다. 이에 본 논문에서는 우리도 범죄로 인한 피해자의 수가 날로 급증함에 따라 피해자지원에 합리적 방안을모색하여 보았다. 피해자지원과 관련하여 우리보다 입법과 각종 정책 등에서 적극적으로 대처하고 있는 일본의 경우를 검토하였다. 일본은 앞서 본문에서도 살펴 본 바와 같이 민간단체, 경찰, 검찰, 재판소(법원) 등 다각도에서의 범죄피해자 지원에 적극 대처하고 있다. 다각도에서의 지원은 피해자가 범죄피해발생 이후 경찰과 검찰, 재판소 등 피해자로서 당사자적 위치를 차지하고 참여하고 있기 때문일 것이다. 피해자지원은 어느 한 사람 또는 한 기관에 의해서만이루어질 문제는 아니다. 범죄피해자의 정신적피해는 피해자가 생을 마감하는 날까지 잊지 못할 것이지만 사회구성원으로서 사회에의 복귀와생활을 지속적으로 이어나가야 하므로 육체적인피해만이라도 하루 빨리 회복하여 사회구성원으로서 생활을 영위해 나갈 수 있도록 우리 사회가전방위적으로 지원해야 한다. 이러한 면에서일본의 다각도에서의 범죄피해자 지원은 피해자가 각 단계에서 피부로 느낄 수 있는 어려움들을도와 원상으로의 회복에 적극적으로 대처하고 있음을 알 수 있다. 이에 우리도 민간단체를 통한적극적인 지원방안의 모색과 각 형사절차의 진행과 더불어 어려움을 겪을 수 있는 피해자를 적극지원함으로써 다각도적인 피해자지원에 적극적으로 대처해야 할 것이다. 따라서 본 논문에서는일본의 전방위적 피해자지원의 내용과 우리의 지원방안 등에 대하여 검토하여 보았다. 아무쪼록본 논문이 우리의 범죄피해자 지원정책에 일보전진할 수 있는 계기가 되기를 바란다.
A crime occurs every day recently. In addition, also are turning into violence and specialized day by day. Generally, it may be said that there is not the crime without the victim. Therefore, if quantity of crime outbreak increases, I get together, and the numbers of the victim should increase. In this paper, we date the number of victims of crime, driven primarily by increasing support for victims and was looking for ways to rationally. Than we are with respect to victim support legislation and actively cope with the various policies, etc. were investigated in the case of Japan. Japanese NGO, police, prosecutors, courts in various angles are responding actively to support victims of crime. Angles occur in the future victims of crime victim assistance police and prosecutors, courts, etc. Our efforts are a victim involved was because the position occupied. Support for victims of any one person or one issue is made only by institutions. Psychological damage of a victim of crime victims will never forget until the end of his life, but a return to society as members of society and life continues after physical damage, so get out your chest as soon as possible to regain the life given us, as members of society continue to be should support the full range of our society. In this respect, Japan’s support for crime victims in various angles to the skin from each procedure to help them to feel the difficulty in supporting the restoration of the original state is responding aggressively. Therefore, I examined support contents of the victim in Japan and support plan of Korea in this report.
