Critical Review on the Grammatical Interpretation of the Supreme Court Decision (2010do3358) on the Definition Provision of Game Product

이 논문은 「게임 산업 진흥에 관한 법률」 제2조 제1호 본문에 규정되어 있는 게임물 정의 조항의 문리해석에 관한 2010년 6월 24일의 대법원 판결(2010도3358)을 비판적으로 검토하고자 하는 것이다. 대법원에 제기된 사건의 쟁점은 영상물 없이 기계 동력 장치로만 작동되는 크레인 게임기가 게임물에 해당하는가 여부였다. 이에 대해서 대법원은 게임물 정의 조항의 “영상물 또는 그 영상물의 이용을 주된 목적으로 제작된 기기 및 장치”를 ‘영상물’, ‘그 영상물의 이용을 주된 목적으로 제작된 기기’, ‘장치’의 세 가지 대등한 의미 요소로 나누어 해석하였다. 크레인 게임기는 ‘장치’에 해당하므로 ‘게임물’ 된다는 것이다. 그러나 엄정한 문리해석에 따르면, “영상물 또는 그 영상물의 이용을 주된 목적으로 제작된 기기 및 장치”의 의미는 ‘영상물’과 ‘그 영상물의 이용을 주된 목적으로 제작된 기기 그 밖에 장치’ 중의 하나를 선택하는 것이다. 따라서 크레인 게임기는 영상물이 없으므로 게임물에 해당하지 않는다. 법관이 문리해석을 남용하는 것은 논증의 부담을 완화시키려는 유혹 때문이다. 법관이 반드시 문리해석에 구속되지는 않지만, 엄정한 문리해석의 태도를 강조하는 것은 법관의 자의성을 통제하고자 하는 법치주의의 요청에서 비롯된 것이다.

This paper is critically reviewing on the Supreme Court decision (2010do3358) at June 24th, 2010 which is the grammatical interpretation about the definition provision of game product that is regulated on the Act on Promotion of Game Industry Article 2 first clause. The issue of the case that raised in the Supreme Court is whether the crane game machine that is operated by machinery power equipment without image product is legally game product or not. According to this, the Supreme Court interpreted the definition provision of game product, “image product, or instrument and equipment produced for the main use of that image product.” to ‘Image Product’, ’Instrument that is produced for the main use of that image product’, and ‘Equipment.’ Crane game machine is equipment. Therefore, crane game machine is the game product. But according to strict grammatical interpretation, “image product, or instrument and equipment produced for the main use of that image product” of the definition provision of game product, is choosing one of the ‘image product’ and ’instrument and other equipment that is produced for the main use of that image product.’ Crane game machine does not have image product, so it is not game product. Judge abusing grammatical interpretation is because of the lure releasing burden of reasoning. Judge is not surely under arrested of grammatical interpretation, but stressing strict grammatical interpretation regulates judge’s arbitrariness which is request of rule of law.
