본 논문에서는 한중 FTA 내 역외가공지역 규정에 따른 개성공단의 활성화 방안에 대하여 고려하였다. 나아가 한반도 경제특구의 경제발전을 고려하는 동시에 추진 시 예측할 수 있는 갈등에 대하여 분석하였다. 특히 북한의 경제특구를 남북한 간 2개 지역과 북중 접경 간 3개 지역으로 분류하여, 구분되는 두 개 영역 간 운영상에 영향을 끼치는 갈등 구조의 유사성과 상이성을 분석하였다. 갈등 양상은 크게 북한 체제의 문제점과 특구 내에서의 사건·사고로 나눌 수 있다. 갈등을 유발하는 북한 체제의 문제점이란 북한 내 정권이양(세습), 북핵 문제, 북한 내 권력 교체 등을 들 수 있으며, 특구 내 사건·사고는 금강산 관광객 피살사건, 특구 내 교통사고, 한국 측 노동자 억류 등으로 분류 가능하다. 결론적으로 북중 접경지대 경제특구는 북한정권 자체의 불투명성, 예측 불가능성에 의존하는 경향이 있으며, 남북한 간 경제특구에서는 오히려 사건·사고에 따라 운영상의 부침을 겪어 왔다. 이에 전자와 후자 간 문제점을 조율할 수 있도록 역외가공지역에 대한 초국가적 체제와 제도를 정비할 필요가 있으며, 이를 한중 FTA 역외가공지역위원회에서 추진해 나아갈 수 있을 것이다.
This study reviews the benefits of he Korea-China FTA, and expectations of the Korea-China FTA in point of the Outward Processing Zone(OPZ) requirement, thereby providing the policy implications. This study also have deal with valuation for OPZ of the Korea-China FTA and its confronted problems and strategies for economic development of the Korean Peninsula. North Korea specified two OPZs between South and North, such as Kaesong Industrial Region and Mount Kumgang Tourist Region, three areas between North Korea and China such the Najin-Sunbong area, Sinuju and Hwanggumpyong Island as free trade and economic zone. Aspects of the conflict can be divided into incidents and accidents in the regime of the problem and zones. The cause of the conflict is causing problems for the regime in North Korea,; regime transfer (succession), tnuclear issue including the replacement of power. Events that causes the conflict and the accident in the OPZs are as follows.; Mount Kumgang tourist murder case, special zones within a traffic accident, Korea side workers detained In conclusion, whether or not to activate the OPZ between North Korea and China tend to rely on the opaqueness, the unpredictability of the regime of North Korea itself. On the other hand, the way how to activate the OPZ between South-North depend of according to the incident an accident.
