인구 고령화의 상승은 국가마다 속도와 정도의 차이가 있지만, 21세기 선진국에서 공통된 사회적 현상으로 해결해야 할 국가적 아젠다이다. 우리나라는 선진국과 비교해 급속도로 고령화가 되고 있다. 최단 기간(2000~2026년의 약 25년) 내에 고령화사회에서 고령사회 혹은 초고령사회로 진입할 전망이다. 이러한 인구고령화의 현상이나 이에 따른 재정 불안의 우려 등을 고려할 때, 고령 인력의 활용도를 증가시키는 것은 노동시장에서 핵심 과제이다. 이를 대비하기 위한 고령자 고용안정ㆍ촉진방안의 노동법정책 개편방안 연구는 매우 시의 적절하며 필요한 정책이다. 현행 노동법제도는 고령화시대에 사회적ㆍ경제적 충격을 완화해 적응하는데 불합리하고 비현실적인 부분이 많다. 현안의 고령화의 문제를 해결하기 위하여 고령화의 노동력과 노동시장의 변화 전망을 통하여 향후 고령자에 대한 노동법정책의 개편방안을 수립하는 것은 필수적이다. 본고에서 논의하는 순서는 다음과 같다. 먼저, 고령자의 현황, 기업의 고령자 실태를 살펴본다(Ⅱ). 또한 기존 고령자의 고용대책에 대한 효과 분석을 살펴본다(Ⅲ), 그리고 선진국의 고령자 고용안정ㆍ촉진제도를 검토한다(Ⅳ), 아울러 우리나라에서 고령자의 고용안정 및 고용촉진방안을 살펴본다(Ⅴ). 마지막으로 결론에서는 논의를 요약ㆍ정리한다(Ⅵ). 본고를 통하여 고령자 고용촉진ㆍ고용안정의 실태와 제도에 대한 문제점을 규명하고, 그 기능적 한계를 개선하기 위한 고령자 고용안정ㆍ촉진을 위한 노동시장정책을 추진할 경우에 입법정책이나 노동정책대안으로 활용할 수 있기를 기대해 본다.
