이른바 ‘음란정보’는 형법상 음란물로서 그 유통이 금지되어 있고, 특히 인터넷(사이버)음란물은 정보통신망법에서 별도의 구성요건으로 특별히 규제되고 있다. 최근에는 스마트폰이 인터넷보다 더 많이 이용되고 있는바, 그 이용자들 특히 청소년들에게 사이버음란물 접촉의 기회를 제공하는 매우 위험한 매개체의 역할을 하고 있어 문제가 심각하다. 인터넷상 음란정보의 유통에 대하여는 학계 및 실무계에서 그 실태와 대응책에 관한 연구논문이 꾸준히 나오고 있으며, 사이버음란물죄로 기소되는 사건도 많아 이와 관련하여 그 개념, 전시 및 링크 등의 형사책임에 관하여 대법원 판례도 일부 축적되고 있는바, 이 시점에서 그 동향을 정리해보고자 한다. 논문의 본문에서는 인터넷상 음란정보의 개념, 전시와 링크의 형사책임 문제 등에 관하여 관련 대법원 판례들을 찾아 각각의 개요를 정리함으로써 그 흐름과 동향을 정리하고, 아울러 미국의 판례동향도 언급함으로써 국내 사이버음란물 법제 개선에 실마리를 제공하고자 한다. 입법론상 음란물에 관한 죄는 성인보다는 청소년보호를 목표로 이루어져야 한다. 특히 오늘날 인터넷을 통한 각종 음란정보의 무분별한 침투는 청소년들에게 매우 심각한 악영향을 미치고 있는 것이 현실이다. 그럼에도 불구하고 이와 같은 다양한 내용의 사이버음란물죄를 기본법인 형법에서 체계적, 통일적으로 규정하지 못하고, 각종 특별법에 산재하여 규정하고 있는 것은 형법체계상 바람직하지 못하므로 이에 관한 전면적 재검토가 요망된다.

However, it's not important what the correct definition is. The important thing is to make a distinction between punishable obscene materials and unpunishable obscene things. Cyber pornography is traded on the Internet around the clock. Pornographers use the Internet's ease of distribution to sell their materials. In addition to purchasing pornography, people visit many online sites hoping to look for pornography. For reference, the U.S. Department of Justice prosecuted an increasing number of people for Internet child pornography. The existing federal laws against child pornography are extensive and apply to all kinds of child pornography and the luring of minors online and offline. They prohibit the production, interstate transportation, receiving or distribution of visual images of a minor engaged in sexual conduct, and luring a minor into sexual encounters. This article is dealing with some judicial decisions on the Internet Pornography delievered by the Korean Supreme Court. The biggest challenge to law enforcement in cyber pornography cases is the anonymous nature of Internet communications. The offenses also occur at high speed across the entire nation crossing many law enforcement jurisdictions. Generally sellers and buyers are in different places or could be anywhere worldwide. The coordination between local law enforcement officials and foreign ones is also essential in other Internet legal activities.
