일반최상위 도메인을 관리하는 ICANN이 정한 UDRP에 따라 도메인이름을 이전하라는 미국 국가중재위원회의 결정이 내려진 경우, 도메인이름의 선등록자는 위 UDRP 결정의 집행을 보류하기 위한 불복의 방법으로, UDRP에 따른 분쟁해결절차의 신청인을 상대로 도메인이름등록이전청구권 부존재확인 등을 구하는 것이 일반적이다. 이 글은 법원이 위와 같은 UDRP에 따른 분쟁해결절차의 신청인에 대한 도메인이름 등록이전청구권 부존재확인 청구를 인용할 경우 발생될 수 있는 다양한 법적 쟁점을 대상판결을 기초로 하여 검토한 것이다. 본고에서 다룬 대상 판결 역시 위와 같은 형태를 취한 소송 중의 하나로, (1) 우리나라 법원이 이 사건에 대해 국제재판관할권을 가지는지 여부, (2) 도메인이름사용금지청구권과 이전등록청구권 부존재확인 청구에서 확인의 이익 존부, (3) 도메인이름에 대한 이전청구가 허용되는지 여부(UDRP나 ACPA를 근거로 도메인이름사용금지청구와 이전등록청구가 가능한지 여부) 등이 쟁점이 된 사안이다. 또한 이와 관련하여, 실정법상 도메인이름 등록이전청구권이 인정되지 않음에도 원고의 도메인이름 등록, 보유 및 사용행위가 부정경쟁행위에 해당한다는 이유로 도메인이름 등록이전청구권 부존재확인청구를 기각할 수 있는지 여부에 관하여 하급심법원의 판결이 통일되지 않은 상태이고 아직 대법원 판결이 확립되지 않아 논란이 되고 있으므로, 이를 함께 살펴보고 이로 인하여 발생될 수 있는 문제점과 입법 방향에 대하여도 논하기로 한다.
In the event a holder of the rights to a domain name obtains a UDRP dispute mediation decision for the transfer of the registration of the domain name, the registered holder of the domain name commonly brings a lawsuit to obtain a declaratory judgment that confirms the non-existence of the right to claim transfer of the registration of the domain name. This paper deals with the various issues that can arise in a case where a court issues such a declaratory judgment confirming the non-existence of the right to claim transfer of the domain name registration pursuant to the UDRP; these issues are related to International Jurisdiction; Claimant's Interest in Obtaining Confirmation in a Claim for Confirmation of Non-existence of the Right to Claim Prohibition of Use, and Transfer of Registration, of Domain Names; Governing Law; Permissibility of Bringing Claim for Transfer of Registration of Domain Names (Permissibility of Bringing Claim for Prohibition of Use, and Transfer of Registration, of Domain Names pursuant to UDRP or ACPA). Moreover, there is controversy over whether a court should unconditionally accept a plaintiff's claim just because the right to claim transfer of the registration of domain names is not recognized within the boundaries of existing laws. Also, the Supreme Court has not yet issued a conclusive judgment on this issue, and the lower courts have been issuing conflicting judgments. This paper thus addresses the issues that can arise in enforcing UDRP decisions on an international level and examines potential legislative responses to these issues.
