정부는 화물운송시장의 비정상적인 다단계운송거래 구조를 개선하기 위하여 2011. 6. 15. 화물자동차 운수사업법을 개정하였다. 그 제도들이 얼마나 실효성을 거둘 수 있는 지는 장차 시행을 통하여 판명되어 질 것이나, 그에 앞서 그 제도가 가지는 의미에 대한 법적 검토가 선행되어야 한다. 법적 검토를 함에 있어서는 화물자동차 운수사업법의 화물자동차 운송사업, 화물자동차 운송주선사업, 화물자동차 운송가맹사업의 각 사업영역은 어떻게 되고, 그 법률관계는 어떻게 되는지에 대한 규명이 필수적인 전제가 될 것이다. 위와 같은 규명을 통하여 형성한 화물자동차 운수사업에 대한 전반적인 법적 이해의 틀 위에서, 개정 전의 화물자동차 운수사업법이 다단계 거래구조를 개선하기 위하여 가지고 있던 화물자동차 운송사업자의 직접운송의무, 화물자동차 운송주선사업자의 재계약금지, 재중개ㆍ대리의 금지 제도의 법적 의미는 어떤 것인지를 살펴본다. 그 후, 비로소 개정으로 신설되거나 개정된 화물자동차 운송사업자에게 적용되는 직접운송 의무비율제도, 화물자동차 운송주선사업자에게 적용되는 운송계약을 체결한 화물에 대한 중개ㆍ대리 의뢰, 화물자동차 운송사업자와 화물자동차 운송주선사업자 모두에게 적용되는 위탁화물에 대한 관리책임, 위탁화물증의 교부, 운송실적에 대한 신고ㆍ관리 제도에 대한 법적 고찰과 평가를 도모한다.
On June 15, 2011, the Korean Government amended the Truck Transportation Act to improve the abnormal multi-level transportation deal structure. While how effective the new measure is will soon become clear in the near future, an examination of the legal aspects of the measure before its enforcement merits inquiry. To review the legal meaning of the measure, it is necessary to investigate the business area and the legal relationship between the truck transportation business, motor freight forwarding business and truck transportation affiliated business of the Truck Transportation Business Act. In order to understand such review of the transportation business, I closely looked at the legal significance of the direct transportation duty of truck transportation business operator, the prohibition of the extended contracts and re-mediationㆍagency of the motor freight transportation business operator to improve the multi-level transportation deal structure of the former Truck Transportation Business Act. Lastly, I tried to make a legal examination and assessment of the newly adopted or revised improvement measures, such as the direct transportation duty rate of the truck transportation business operator, the mediationㆍagency request on the transportation contract freight of the motor freight transportation business operator and the management responsibility about the freight on consignment, delivery of certificate or receipt of freight, and the performance report on the transport.
