2009년 법학전문대학원 체제의 도입 이후 법학교육의 기능은 이론교육과 실무교육을 병행함으로써 실제 법률사건을 처리할 수 있는 전문가로서의 능력을 갖춘 법조인을 양성하는 것으로 이해되고 있다. 그런데, 변호사 자격은 법학전문대학원을 수료하고 변호사시험에 합격한 자에게만 부여되므로, 변호사시험은 법학전문대학원의 교과과정에 지대한 영향을 미칠 수밖에 없다. 현재 변호사시험은 필수과목과 선택과목으로 구성되어 있으나, 특정 선택과목에 응시하기 위해 수험생이 사전에 어떤 교과목을 반드시 이수해야 하는 것은 아니다. 결과적으로, 수험생들은 선택과목의 선택에 아무런 제약을 받지 않으므로, 법학전문대학원 재학 중에는 주로 변호사시험의 필수과목과 관련된 분야의 교과목만을 이수하고, 변호사시험의 선택과목은 상대적으로 점수따기에 유리한 과목을 선택하는 경향이 있다. 다양한 분야의 전문가를 양성하기 위해서는, 법학전문대학원에서 다양한 분야의 특성화교육을 시행할 필요가 있으나, 현재와 같은 상황에서는 그러한 과목은 유지조차 어려운 까닭에 법학전문대학원에서 교과운영은 사실상 필수과목 위주로 이루어지고 있는 실정이다. 본고에서는, 이러한 문제의 해결책으로, 변호사시험의 선택과목을 폐지하는 대신 법학전문대학원의 교과과정에 다수의 선택과목군을 설정하고 본인이 선택하는 특정 선택과목군에 속하는 일정 수 이상의 과목을 이수하는 것을 졸업 및 변호사시험 응시조건으로 요구하는 것을 제안하고 있다.
Since the introduction of law schools in 2009, it is expected that legal education at law schools should consist of both academic stage and vocational stage so that the graduates from a law school should be equipped with a professional capability to handle actual legal cases. As the professional license is given only to those passing the bar exam after graduating law school, bar exam greatly affects actual operation of law school curriculum. Currently, bar exam consists of mandatory subjects and elective subjects, but there are no prerequisites required for selecting elective subjects. This means it is possible for bar examinees to select an elective subject without having taken any regular course in that area of law while in law school. As a matter of fact, majority of students, while in law school, only take courses related to the mandatory subjects of the bar exam and they seem to look for easy ones for selection of optional subjects for the bar exam. In order to raise specialists in diverse fields of law, it is necessary to maintain diversity in the law school curriculum but it is not easy under these circumstances. To redress these problems, this article suggests to do away with optional subjects in the bar exam. Instead, optional subjects should be grouped into a number of categories and as a prerequisite to take the bar exam, law school students should be obliged to take a certain number of courses in one of these categories.
