이 연구는 법전원 졸업생이 갖추어야 할 핵심역량으로 요구되는 자질과 능력이 무엇인지 탐색해 보고자 하는 목적으로 수행되었다. 이러한 목적을 달성하기 위해서 먼저 미국 ABA 로스쿨평가와 일본 법무연구재단의 인증평가기준에 제시되어 있는 법조인 양성교육에서 길러야할 자질과 능력을 분석․검토․종합하여 법전원 졸업생에게 요구되는 자질과 능력에 관하여 7개 영역 및 18개 항목의 핵심역량을 도출하였다. 그리고 법전원 교수, 법전원 출신 법조인, 사법고시 출신 법조인 총 365명을 대상으로 법전원 졸업생에게 요구되는 18개의 자질과 능력을 조사항목으로 하는 핵심역량의 중요도에 대한 설문조사와 분석을 하였다. 이 연구에서는 법전원 졸업생이 갖추어야 하는 핵심역량으로 ‘법조 직업윤리’, ‘법조지식․사실조사 및 인정능력’, ‘법적논의․표현․커뮤니케이션 능력’, ‘법적추론․적용문서작성 능력’ 이상 4개 영역으로 구분하고, 4개 영역별 자질과 능력을 구체적으로 제시하고 있다.
This research is to examine what kind of mind and ability law school graduates need for core competency in their fields. For this, firstly, the accreditation standards of the ABA Law School in USA and the Legal Research Funds in Japan should be analyzed, investigated and synthesized in their education for lawyers. After viewing the accreditation standards, the study has found the results of 7 areas and 18 items of its mind and ability to be asked to law school graduates. From there, the results of the questionnaire and analysis about the significance of core competency survey 18 items of mind and ability to law school graduates; who are currently law school professors, lawyers from law school and lawyers from judiciary examination, 365 participants in total. This article suggests 4 areas of core competencies of law school graduates like 'lawyer's professional ethics', 'lawyer's acknowledgement·fact-finding investigation and ability acceptance', 'legal debate·presentation·communication capacity', 'legal reasoning·document task ability and 4 areas of mind and ability like those items.
