이 논문은 <법과 문학>의 전망 하에서 이병주의 문학을 검토한 것이다. 학제적 연구방법으로서의 <법과 문학>은 현재 문학 쪽에서 문학법리학이라는 이름으로 부상하고 있어 이 제목을 취했다. 작가 이병주는 등단작 「소설･알렉산드리아」(1965)에서부터 개인적 복수의 정당성의 문제와 소급법의 문제, 그리고 사형제도의 비인간성 등을 고발한 작가로, 이후 일련의 작품을 통해 법적 정의에 의문을 제기하고, 법의 존재를 둘러싼 다양한 물음을 제기한 작가다. 이병주는 초기소설에서 의사-법률이야기 혹은 대항적 법률이야기(counter-legal story)를 집중적으로 창작하는데, 그 핵심은 법이 그 자체로 일관되고 완전한 연역적 체계이지만 더 근본적으로는 어떤 사회를 유지시키기 위해 요구되는 사회적 허구(fiction)의 일종이며, 그런 만큼 법리 자체에 대한 회의가 있을 수 있고 또 반드시 필요하다고 하는 것이다. 법이 한 사회의 제도적 허구의 일환이라는 점, 그리고 그런 만큼 대항적 허구에 의해 스스로를 갱신하지 않는 한 그 법은 맹목일 수밖에 없으며, 그런 시대를 살아가는 사람들의 삶은 근본적으로 부조리한 것이 될 수밖에 없다는 인식을 이병주는 초기 소설에서 집요하게 거론하고 있다. 이병주는 이처럼 현실적으로 구속력을 갖는 법리 자체에 대한 끝없는 반성을 자신의 소설을 통해 촉구한 것인데, 이 점에서 그는 법적 허구와 맞서는 문학적 허구의 본질적으로 대항적인 성격을 인식한 거의 최초의 작가로서, 우리문학에 대한 문학법리학적 고찰에 가장 적절한 작가라 할 수 있다.
This treatise is an exemplary study on the fictions of Lee Beong-Joo in the perspective of the Law and Literature. As an interdisciplinary study, ‘law and literature’ is nowadays accepted as a meaningful approach to literature. Literary Jurisprudence is another term of ‘law and literature’ approach in terms of perspective of “public imagination” which is given by M. Nussbaum. In the perspective of literary jurisprudence, novel is accepted as a public genre which come into question of the legal system of society. Lee Beong-Joo is a pioneer writer who raised the problem of the nature of law through his fiction writing in modern Korean literature. Many of his fictions shows literary fiction is a counter-discourse to legal discourse in a society, and his fictions can be estimated as counter-legal story against the stubborn legal discourse of Korea. Lee Beong-Joo often creates a writer as a character and contrasts him against a lawyer character, and emphasize the constant renewal of law through their dialogues and many sorts of legal stories. Death penalty and retroactive law is representative laws he had disputed through his works of fiction. His initiative works of this theme can be the first and relevant literary properties of literary jurisprudence of modern Korean literature.
