조약에 관한 비엔나 협약(비엔나협약)은 제31조는 해석의 일반규칙으로 신의성실원칙을 규정하고 있다. 당사자들의 자유로운 동의와 신의측과 신의성실원칙 적용이 보편적으로 인정되고 해석의 기본 출발점이 된다. 비엔나협약의 해석규칙은 무한한 법원칙을 반영하고 있고, 비엔나 협약 제32조는 보충적 해석수단을 규정하고 있다. ICJ는 특별한 인권제도의 개념에는 의지하고 있지만, 인권조약의 해석에 있어서 특별한 방법을 따로 적용하지는 않고 있다. 유럽인권협약을 해석하는데 있어서 유럽인권재판소의 많은 판례는, 재판소는 문언적 접근의 협약적용으로부터 시작하여 개인의 권리에 힘을 불어넣어 주기 위하여 목적론적 해석에 크게 의지하고 있다. 인권조약의 해석과 적용을 규율하는 원칙은 일반해석원칙과는 달리 특별하지 않다는 점이다. 인권법의 특수성이나 인권의 보편성이 일반적으로 재판과정에서 고려되지 않고 있으나, 어떠한 경우도 효과를 부여하고 결정이 이루어지기 전에 이러한 성격이 입증되어야 한다. 국제인권조약에 적용되는 해석원칙은 국제법의 일반적인 해석에서 실제적으로 벗어나지 않고 있다. 국제사법체제를 통한 점진적이고 균형 있는 해석원칙을 취하는 것은 기본적으로 신의측(good faith)과 협력의 정신(a spirit of cooperation)에 그 근간을 두고 있다. ICJ는 다양한 UN인권협약 감독기구가 표명한 견해를 해석에서 강조하고 있다. 국제인권조약상의 각 권리와 개념이 구체적으로 정의 내려져 있지 않고 추상적인 경우가 많다. 예컨대 사상, 양심과 종교의 자유와 같은 개념이 관용의 정신에 그 근간을 두고 있듯이, 오히려 이러한 인권개념의 모호성이 앞으로 발생할 수 있는 모든 인권탄압이나 박해를 포용하고 다양한 권리를 수용할 수 있는 가능성을 열려 둔 것으로 볼 수 있다. 국제인권법의 원칙으로서 보편성, 민주적 정당성, 정의, 보호, 합법성, 존중과 보장, 평등, 무차별과 구제의 원칙으로서, 인권조약의 해석․적용에 있어 이들 원칙과 정신에 입각하여, 개인의 자유로운 의사와 신의 측에 따라 확대 해석되고 적용되어야 할 것이다.
Vienna Convention on treaties (Vienna Convention) article 31 provides for the principle of good faith (pacta sunt servanda) as a general rule. free consent of the parties, good faith are generally accepted in interpretation as a basic starting point. The interpretation rules of the Vienna Convention reflect the infinite law principles, and the Vienna Convention article 32 stipulates supplementary means of interpretation. International Court of Justice (ICJ) adjudication depends on the concept of a special human rights institutions, but in interpreting human rights treaties it has not applied particular way of these. In the interpretation of the European Convention(the Convention) on Human Rights, European Court of Human Rights on many of the precedents has applied the Convention greatly reliant on the teleological interpretation in order to give the power to individual's right. In European Human Rights Commission these considerations should be taken into account in interpreting the Convention.. (1) The general context of the Convention, including its Preamble, as well as its object and purpose. The text or wording of an article serves as a point of departure. (2) The general rules of international law, particularly those expressed in the Vienna Convention on the Law of Treaties. (3) The special features of the European Convention, especially the fact that the obligations undertaken thereby are of an objective character. (4) The pragmatic, as distinct from a merely linguistic, interpretation should be applied in determining the natural or ordinary meaning. of the text. (5) In case of ambiguity, the extended meaning of the relevant obligations should be preferred to that which restrict such obligations. (6) The travaux preparatoires can be taken into account as supplementary means of interpretation as a guide to the general intentions of the parties, but with due regard to the principle that the Convention must be interpreted objectively with the aim of making the protection of the individual effective. (7) International instruments with similar provisions to those of the Convention may be taken into account. (8) The national law practice may be taken into account, but this is not decisive for the interpretation of the terms used in the Convention, which embody autonomous notions. (9) The Convention must be interpreted in the light of present day conditions. Principles of interpretation and application of human rights treaties, unlike the general is not that special. Interpretation principles of international human rights treaties are not in practice without departing from the general interpretation. Through an international judicial system to take a gradual and balanced interpretation of the principle, interpretation basically bases on good faith and a spirit of cooperation. ICJ has expressed its view and highlighted the analysis of UN monitoring bodies of UN Human Rights Convention. International human rights treaties on the rights and the concept of each are not specifically defined and they are often abstract. For example, thought, conscience and religious freedom are rooted in the spirit of tolerance, rather the ambiguity of the human rights concept can occur in the future to embrace all human rights abuses and persecution, and could mean to accommodate a variety of possibilities. In principle, as principles of international human rights law, in the light of the universality of international human rights, democratic legitimacy, justice, protection, legitimacy, respect and security, equality, principle of non-discrimination and relief, interpretation of human rights treaties should be faithfully interpreted and applied to extend individual personal freedom of will.
