우리 관세법은 헌법질서를 문란하게 하거나 공공의 안녕질서 또는 풍속을 해치는 서적·간행물·도화, 영화·음반·비디오물·조각물 또는 그 밖에 이에 준하는 물품은 수입을 금지하고 있다(관세법 제234조). 따라서 위 물품을 수입하거나 국민보건 등을 해칠 우려가 있는 경우에는 해당 물품의 통관을 보류할 수 있다(관세법 제237조). 이 조항을 근거로 관세청은 자위기구 등 성인용품을 풍속을 해치는 물품으로 보아 원칙적으로 통관을 보류하는 처분을 하고 있다. 먼저 위 법상 ‘풍속을 해치는’의 개념이 추상적이고 불명확하여 명확성의 원칙에 반하는 의문이 있다. 우리 법원은 이를 ‘음란성’과 같은 맥락에서 해석하여 명확성의 원칙에 반하지 않는다고 보고 있다. 그러나 ‘음란성’이라는 것도 역시 시대와 장소에 따라 그 의미가 달라질 수 있는 불확정개념이다. 결국 ‘풍속을 해치는 물품’이란 ‘음란한 물품’이라는 말로 치환될 뿐이고, 그 의미는 여전히 불확정개념으로 남아 있게 된다. 자위기구 등 성인용품을 풍속을 해치는 물품이라고 하여 일률적으로 수입통관 자체를 보류하는 것은 성적 자기결정권을 원천적으로 제한하겠다는 행정상 제재로 보인다. 성적 자기결정권도 헌법 제37조에 따라 공공복리나 질서유지를 위해 일정한 정도의 제한을 받게 되는 것이 당연하다. 그러나 자위기구 등 성인용품의 특성과 사용상의 은밀성, 장애인이나 독신자 등 특별한 사정으로 성인용품을 사용할 수 밖에 없는 사람들의 성적 자기결정권을 특별히 보호할 필요가 있는 점, 미성년자를 보호하기 위한 장치가 되어 있는 점 등을 고려하면 성인용품을 원천적으로 통관보류하는 처분은 성적 자기결정권을 과도하게 침해하는 것으로 볼 수 있다. 입법적으로는 수입금지 물품을 ‘포르노그라피’라는 기술적인 개념으로 대체하고, 하드코어 포르노그라피는 원칙적으로 수입을 금지하되 소프트코어 포르노그라피에 대해서는 원칙적으로 수입을 허용하고, 예외적으로 세관장이 심의위원회의 자문을 거쳐 수입을 금지할 수 있도록 개정하는 것을 고려해 볼 수 있다. 다만, 아동․청소년 포르노그라피에 대해서는 소프트코어 포르노그라피에 해당한다고 하더라도 보호법익의 중요성을 고려할 때 원칙적으로 수입금지 대상에 포함시켜야 할 것이다.
According to Customs Act article 234(Prohibition on Export and Import), Books, publications, drawings, records, films, videos, sculptures and other similar goods which disrupt the constitutional order, disturb the public safety and order or corrupt public morals shall not be exported or imported. Where matters of obligation under the provisions of this Act are violated or the public health, the head of any customhouse may withhold customs clearance for the relevant goods(Customs Act article 237). Customhouse on the basis of this provision withholds customs clearance for sexual-device. Our courts have interpreted 'public morals' as 'obscene'. However, 'obscene' is depending on time and place that it is also subject to its meaning in the indeterminate concept. Withholding customs clearance for sexual-device seems to saction administrative intends to limit to sexual self-determination right. Sexual self-determination right may be limited according to Constitution Article 37 in order to maintain the public welfare. However, the right can not be limited by the intrinsic contents, and even limit the infringement of the principle of the minimum. Legislatively it is necessary to change 'public morals' to 'pornography', which is a technical concept. Among pornography, the soft-core pornography is principally allowed to import. Sexual-device is also contained soft-core pornography. But the head of any customhouse may withhold customs clearance after examinating by a judging committee. However, the children's pornography, even soft-core pornography, that should be prohibited when considering the importance of children sex protection.
