우리나라를 둘러싼 테러양상과 테러환경도 국내외안보 환경변화에 따라 점진적으로 다양화 되고 있다. 즉 국제적으로 테러사건은 지구촌 곳곳에서 빈발하는 추세이며, 국내적으로도 국제결혼, 외국인노동자, 새터민의 증가로 인한 자생테러 발생가능성우려와 함께 북한에 의한 후방 테러위협과 전면전(全面戰)앞서 예상되고 있는 비대칭전력으로서의 테러공격은 그 위험성이 점차 증가하고 있는 게 현 실정이다. 그러나 이러한 테러 환경의 변화에 대한 국민들의 전반적인 인식은 매우부족하고 이에 대한 논의는 지금까지도 활성화되지 못하고 있는 것이 현실이다. 더구나 테러상황이 예상되거나 발생 시 가장밀접하게 국민생활현장에서 치안활동을 담당하고 있는 경찰의 입장에서는 이에 대한 다양한 조치를 담당 하여야 함에도 불구하고 관련법규가 미흡 한 것 은 경찰활동의 제약으로 큰문제가 되고 있다. 따라서 우리경찰은 시대적 변화에 따라 확대된 다른 임무와 역할을 다하기 위해 노력해야 할 과제를 안고 있다. 즉 사법적·행정적 역할을 충실히 이행하기 위한 경찰의 본연의 임무는 물론 대테러활동 등 국가안보를 위한 보안경찰분야의 역할도 강화하여야한다. 그러나 경찰의 테러대응체계는 이처럼 현장 대응능력이 곧 국민의 안전 및 인권보장과 직결됨에도 불구하고, 실재 현장에서 필요한 체계적이고 조직적인 대응체계가 부재하고 범정부적 차원의 테러대응체계가 정비되어 있지 않기 때문에 테러 발생 시 현장에서의 기관 간 혼란이 우려된다. 따라서 체계적 테러대응시스템 구축을 위해 최 일선 에서 법집행을 하는 경찰 주도의 테러대응체계를 위한 법제화가 절실하다고 할 수 있다. 따라서 국가경찰의 테러대응 책무와 필요한 사항을 명확히 규정하여 테러공격으로부터 국민의 생명과 재산보호 그리고 공공의 안전과 질서유지를 위한 「경찰법」과 「경찰관직무집행법」개정이 시급한 실정이다. 이를 위해서는 무엇보다도 경찰 주도의 테러대응체계 입법을 위해 우선 경찰의 현재의 테러대응체계 문제점을 진단하고 주요 선진외국의 테러대응체계를 분석하여 향후 경찰의 테러대응체계를 설계해야 한다.
