이탈리아･러시아 마피아, 홍콩의 삼합회, 일본의 야쿠자 등 기존 거대 조직범죄집단뿐만 아니라 미국의 남미계･중국계 등 신흥 범죄 조직이 날로 확장되어 국제적인 범죄 카르텔을 형성하고 있다. 탈레반, 알카에다 등 테러조직도 마약ㆍ무기 밀거래 등과 연계를 거치면서 아프가니스탄뿐 아니라 미국, 영국 등에 테러를 가하는 등 수단과 방법을 가리지 않고 있다. 이러한 최근의 국제 범죄조직은 전 세계적인 평화를 위협하고 있으며 이는 사회･문화의 발전도 해치는 중대한 암적 요소로 자라나고 있다. 이러한 국제 범죄 조직에 대한 대응은 유엔을 중심으로 유엔 범죄방지 프로그램의 마련, 국제 조직범죄 대응 조약의 체결과 시행 그리고 국제 조직범죄에 대한 세계행동계획 발표라는 성과를 도출하였다. 그러나 각국과의 협력과 공조에 대한 불협화음, 유엔의 자금부족과 전문 인력 미약 등의 문제에 직면하여 최근 새로운 돌파구 마련에 분주하다. 최근 국내의 범죄조직도 국제 범죄조직과 연계를 맺고 있으며, 국내에서 범죄를 저지르는 외국인의 증가 속도는 다른 국내 모든 범죄율보다 높은 실정이다. 이에 경찰청의 국죄범죄 수사대와 검찰청의 조직범죄과를 중심으로 하는 대응에 대하여 법적ㆍ제도적 보완뿐 아니라 수사 공조 체제에 대한 요구가 높은 것이 사실이다. 국내에도 수백 개의 범죄조직이 활동 중이며 점차 국제 범죄조직과 연계를 맺으면서 합법적 사업에도 진출하고 있다. 이에 2013년 4월 형법 개정안이 통과되어 범죄단체에 대한 대응의 실효성을 높이는 작업이 진행 중이다. 그러나 국제 범죄조직은 세계 각국과의 공조 없이는 일망타진하기 어렵고 특히 유엔의 새로운 동향에 대하여 유연한 자세로 참여하여야 한다. 이에 최근의 유엔 범죄방지 대책을 살펴보고 향후 어떠한 유엔 범죄방직 프로그램이나 조약들, 프로토콜 등이 생성될지에 대하여 예측할 수 있다. 따라서 우선 국내의 범죄조직에 대한 대응방안의 변화를 특히 경찰과 검찰의 수사기구를 중심으로 살펴보고 이의 법적･제도적 문제점을 지적하였다. 아울러 유엔 범죄방지에 적극 참여하는 것은 물론 우리나라와 지역적으로 밀접한 러시아, 중국, 일본과의 동북아 범죄방지 조약 내지는 공조에 대한 필요성을 강조하였다. 국제 감각을 가진 수사조직과 수사진을 갖추는 것은 향후의 국제 테러나 엄청난 국가적 재난을 예방한다는 측면에서 중요한 것이다. 대한민국의 현 경제와 정치는 세계 각국에 많은 영향을 주고 있다. 국제범죄도 이러한 중요성을 피해갈 수 없는 것이다. 이 논문은 바로 이러한 중요성의 길목에서 최근의 유엔 범죄방지 노력을 분석하고 대안을 제시하고자 한 것이다.

Formerly local crime organizations from Ethnic groups like Hispanics and Chinese Americans are internationalizing. The international crime organizations such as the italian Mafia, the Triads of Hong Kong and the Yakuza of Japan are evolving, and extending their business disguised as legal entities. International crime activity especially on the internet could remove the limitations of time and space. Currently international crime organizations are on the move from the real world into the cyber space. All terror organizations source their funds through drug dealings on the black-market and illegal arms transactions. They employ brutal measures to reach their objectives. The attacks from 9-11 also triggered wars between nations, for example the war in Iraq. In the follow-up there was an incident in July 2007 when one Korean, named Kim Sun-Il, was killed by an international terror organization in Afghanistan. International crime organizations always have their roots in one particular country to which they are closely connected. Therefore, it is time that all countries cooperate and take aggressive actions to battle international crime. Therefore, the activities of the United Nations are getting increasingly important. The actions of the United Nations target, among others, the resolution of international conflicts, safety, economic development, protection of human rights, humanitarian assistance, independence from colonialization and development of international law. Up to now organized crime didn't get particular attention from the United Nations and it was only recognized as a phenomenon relating the economy, society, culture and education. The existence of international crime organizations makes counter-terrorism actions necessary. There is also the need for close international cooperation because all international issues are connected to politics, economy and society. Therefore, the role of the United Nations is more important than ever. However, there are limitations of international cooperation due to budget constraints and lack of professionality of the involved parties. Therefore, the role of the United Nations to counteract international organized crime cannot be sufficiently fulfilled. This paper presents an analysis of these limitations and recent tendencies in the prevention of international organized crime. This analysis shows the right directions to counteract international organized crime that Korea should take.
