교육을 받을 권리는 국민이 인간으로서의 존엄과 가치를 유지하며 행복을 추구하고 인간다운 생활을 영위하는데 필수적인 전제이자 다른 기본권을 의미 있게행사하기 위한 기초가 된다. 민주국가의 헌법이 교육을 국가의 중요한 과제로 규정하고 있는 것은 교육을 통한 국민의 능력과 자질의 향상은 바로 그 국가의 번영과 발전의 토대가 되는 것이기 때문이다. 우리 헌법 제31조 제1항에서도 “모든국민은 능력에 따라 균등하게 교육을 받을 권리를 가진다”고 규정함으로써 모든국민에게 교육을 받을 권리를 보장하고 있다. 그런데 교사 경시풍토로 인하여 이른바 교권(敎權)이 추락하여 교사의 교육활동이 방해되고 있다는 것이 오늘날 교육현장의 진단이다. 이 글은 교사가 원활하게 교육활동을 수행할 수 있도록 법제적으로 뒷받침하기위한 방안을 강구함에 있어서 먼저 교육활동의 권원(權原)으로서의 교권 개념을살펴본 다음 교사의 교육활동 침해 내지 교권의 침해 유형, 특징, 최근의 추이(推移) 등을 분석하고, 미국의 연방 교사보호법을 비교법적으로 검토한 후 교육활동보호의 법제적 방안을 모색하는 것을 목적으로 삼는다. 교육활동의 보호를 위한법제적 개선방안으로 생각해 볼 수 있는 것은, 기존의「교원지위향상을 위한 특별법」을 정비하는 방법, 일부 지방자치단체에서 추진하고 있는 바와 같이 이른바「교권조례」를 제정하는 방법, 그리고 별도의 가칭「교육활동보호법」을 제정하는 방법 등이 있을 수 있다.
The right to education is the essential premise of leading a living worthyof human dignity and the firm base of exercise of other fundamental rights. The reason why every constitutional law of democratic countries characterizesthe education issues as the national tasks needing great attention is becauseimprovement of competence and qualification of people through education isthe foundation of national prosperity and development. Article 31(1) of theKorean Constitution also guarantees people the equal right to education byproviding that all citizens shall have an equal right to receive an educationcorresponding to their abilities. By the way, it is a diagnosis from educationfield that educational activities are seriously hindered by a tendency to makinglight of educational authority recently. My main point in this Article is that new legislative measures should bedevised to protect teachers’ justifiable educational activities. From that viewI first try to establish concept of educational authority as the legal basis ofeducational activities. Then I look at the patterns, characteristics, and recenttrends of infringements of educational activities. Lastly, I explore to deduceimplications for「Educational Activities Protection law」in Korea to safeguardteachers’ educational activities through a comparative study on the U.S. federalTeacher Protection Act.
