「학교폭력 예방 및 대책에 관한 법률」(이하에서는 ‘학교폭력법’이라고 한다)이 2004년 제정·시행된 이후 크고 작은 개정이 있었지만, 교육현장에서는 여전히 학교폭력법이 학교폭력을 예방하거나, 학교폭력이 발생하였을 때 교육적으로 대처할 수 있는 적절한 법률인지에 대해 많은 의문을 제기하고 있다. 학교폭력은 가해학생과 피해학생 모두에게 돌이킬 수 없는 정신적·육체적 상처를 남겨 개인의 삶과 학교공동체의 건전한 발전을 파괴하는 반사회적 범죄이다. 그럼에도 불구하고 이 연구에서 학교폭력 사건의 가해학생에 대한 조사와 징계 절차에서 인권과 적정절차를 기본으로 한 교육적인 고려를 주장하고 있다. 이는 학교폭력의 가해자라고는 하지만 아직은 교육을 받고 있는 미성년자이고, 다른 관점에서 보면 여전히 보호 받아야 하는 학생이기 때문이다. 학교폭력법이나 초·중등교육법은 학생을 징계할 때에는 가해학생이나 그 보호자에게 진술할 수 있는 기회를 주도록 규정하고 있을 뿐, 어떠한 절차에 따라 어떻게 진술하여야 하는가에 대한 구체적인 절차와 방법에 대한 규정이 없다. 따라서 이 글에서는 징계절차에서 가해학생이 자신의 입장을 충분히 변명할 수 있도록 하는 교육적 입장에서 그 구체적인 절차에 대해 대안을 제시하고자 하였다. 그리고 비록 가해학생이지만 인격을 고려한 적절한 조사와 징계가 이루어 졌을 때에 비로소 자신의 행위에 대한 반성과 함께 피해학생에게 용서를 구할 수 있을 것이라고 생각한다. 학교는 교육의 장이다. 학생징계절차의 민주화와 투명성 보장은 무엇보다 올바른 교육과 교육제도의 수립으로 이루어져야 한다.

School is a place of education. First and foremost the democratization and the guaranty of transparency in student disciplinary process should be based on the establishment of correct education and education system.
