본 연구는 현재 시행되고 있는 특수교육법인⌈장애인 등에 대한 특수교육법⌋이 가지는 교육학 적 문제점을 분석하고, 그에 대한 개선 방안을 알아보고자 하였다. 본 연구의 목적을 달성하기 위 하여 ‘첫째,⌈장애인 등에 대한 특수교육법⌋의 교육학적 문제점은 무엇인가? 둘째,⌈장애인 등에 대한 특수교육법⌋의 교육학적 문제점에 대한 개선 방안은 무엇인가?’라는 연구 문제를 선정하였다. 본 연구는 문헌 연구를 통하여 연구의 문제를 해결하였다. 특수교육법의 문제점은 특수교육법에서 제시된 목적 자체가 가지고 있는 문제점과 특수교육법에서 제시된 ‘통합교육’, ‘개별화교육’, ‘순회 교육’, ‘진로 및 직업교육’과 같은 특수교육의 내용 및 방법과 관련된 문제점으로 나누어 살펴보았 다. 제시된 문제점에 대한 특수교육법의 개선 방안은 다음과 같다. 첫째, 특수교육의 목적 중의 하 나인 자아실현을 위해서 구체적으로 어떻게 특수교육을 실시해야 하는지에 대한 방안에 관해 법 률로 지정할 필요가 있다는 것이고, 둘째, 현재 통합교육이 이루어지는 곳이 대부분 특수학급이 있는 일반학급임을 고려하여, 통합교육과 개별화교육을 잘 할 수 있는 방안을 마련해야 한다는 것이다.
The purpose of this study is to explore pedagogical problems and tasks of the special education law which is being implemented. In order to achieve the purpose of the study, questions of it are as follows. First, what are the pedagogical problems of the special education law? Second, what are the improvement plans about the pedagogical problems of the special education law? Literature research was conducted in this study. It is found that the problems of the special education law belong to the purpose, integrated education, individualized education, itinerant education, and career and vocational education presented by the law. The improvement plans about the pedagogical problems of the special education law are as follows. First, it is needed to legislate about how to implement in order to achieve the self-realization which is one of the purposes of the special education. Second, it has to make integrated education and individualized education improving well.
