본 연구에서는 사회과 ‘법과 사회’ 교육과정을 미국 변호사 협회(ABA)의 ‘법 교육 가이드’와 비교 분석하여, 사회과 법교육 과정의 체계를 이해하고 법 교육 개선 방향에 대한 시사점을 얻고자 한다. 이를 위해 법교육과정의 목표, 내용, 방법, 평가의 측면에서 12개의 분석 준거를 추출하고 이를 기준으로 ‘법과 사회’ 교육과정과 ‘법교육 가이드’의 내용을 비교 분석하였다. 분석의 결과 법교육과정 개선에 필요한 다음과 같은 시사점을 발견하였다. 우선, ‘법과 사회’ 교육과정에서 법 교육의 목표로서 ‘민주시민의 법적 자질 함양’이 강조되고 있기는 하지만, 기능, 가치 태도 목표의 제시에서 구체적이고 상세한 탐구가 미흡하였다. 둘째, 법 교육 내용의 구성 방식에 있어서도 다양한 사례와 탐구활동의 제시가 강조되고 있지만, 사법, 사회법, 공법 등의 실정법 체계를 바탕으로 내용이 구성되어, 현실 생활에서 경험하게 되는 법적 문제 상황에서 법적 원리의 적용과 법적 문제 해결 과정을 구체적으로 이해하기에는 미흡한 점이 있었다. 셋째, 법교육의 중요한 주제인 정치권력에 대한 법적 통제와 적법 절차에 따른 통치권의 행사 방식에 관한 내용이 교육과정에서 누락되어있었다. 넷째, 다양한 학습 방법을 통해 학생들의 능동적 참여를 촉진하려는 시도들은 많았지만, 범교과적인 통합적 학습을 통한 법교육의 시도와, 학교 밖의 다양한 법교육 프로그램과 연계한 학습 방법의 모색은 제시되지 않고 있다.

But its contents are mainly composed of positive laws like private law, public law, and social law, so it is not sufficient to cope with real legal issues in everyday life. Third, 'Law & Society' curriculum doesn't contain political power matter which is important theme in Law-Related Education, because political power should be controlled by legal system in democratic society. Fourth, there are many factors to promote students' active participation through various teaching methods in 'Law & Society' curriculum. However it is not enough to approach integrated law education with various subjects, and linkage teaching plans with many extra curricular programs
