우리나라의 통신시장은 과거의 독점적 구조에서 점차 경쟁적인 시장구조로 전환되어왔지만 통신산업에 대한 법과 제도는 이에 상응하여 발전하여 왔다고 할 수 없으며, 규제의 접근방식 또한 과거 독점적 구조 중심의 틀에서 벗어나지 못하고 있다. 여기에 통신시장의 발달에 따라 경쟁법의 적용 가능성이 더욱 확대되어 가고 있으며, 이에 따라 통신법적 규제와 경쟁법적 규제가 중복되거나 충돌할 가능성이 더욱 커져 가고 있다. 이러한 중복적이고 비합리적인 규제는 통신산업의 정상적이고 건전한 발전을 저해하는 요인으로 작용할 수 있으므로 통신산업에 대한 규제는 통신시장 구조의 변화 및 발전에 부응하고 그 기술적 특성을 반영할 수 있도록 변화하여야 할 것이다. 이러한 변화에는 통신시장에서의 공정한 경쟁을 보다 적극적으로 추진시킬 수 있는 정책의 수립실천 외에도 시장의 변화를 적절히 반영하지 못하고 있는 비합리적인 규제를 과감히 폐지하거나 완화하는 방안의 수립시행도 포함되며, 나아가서 규제기관들의 책임과 권한을 합리적으로 조정하여 불필요한 사회적 비용의 증가를 초래하지 않도록 하는 방안도 포함된다고 생각된다.

Moreover, the development of telecom industry in Korea has increased the applicability of Competition Law to the industry, and this may cause the overlap or conflict of Telecommunication Law and Competition Law. As this kind of absurdity can obstruct the future development of telecom industry, we should try to devise new regulatory schemes, which include not only the establishment of reasonable policies but also the abolishment or mitigation of current absurd regulations. In addition, I think that the rational allocation of authorities between Fair Trade Commission and Communication Commission is also necessary to eliminate the waste of social costs.
