헌법상의 가치로써 회자되는 “교육자치” 혹은 “지방교육자치”에 대하여 우리 헌법은 침묵하고 있다. 우리의 실정 헌법에서 자치라는 용어를 사용하는 예는 헌법 제8장 지방자치에서 지방자치단체밖에 없다는 사실이다. 우리 헌법은 교육자치라는 용어를 사용한 적도 없을 뿐만 아니라 헌법상의 교육자치(?)에서 ①지방분권의 원리, ②주민통제의 원리 ③일반행정으로부터 교육행정의 분리독립 원리가 헌법상 도출된다는 것도 허상에 불과하다. 교육기본법이 헌법의 교육 관련 조항을 구체화한 법이라는 측면에서 보면 헌법상의 교육 정치적 중립성은 교육의 중립성이라는 상위개념에 의해 포함될 수 있으며 교육의 중립성은 단순한 정치와 교육이 분리되어야 한다는 것이 아니라 정치적․파당적․개인적 편견으로부터의 중립을 요구하고 있다는 것이다. 즉 본 조항은 헌법의 정치적 중립성을 법령에 구체화하면서 교육의 중립성이란 교육의 본래 목적에 따라 기능을 다 할 수 있도록 운영되어야 하며, 교육은 정치로부터 자유가 아니라, 정치적 편견․파당적 편견·개인적 편견을 전파하는 수단이 되어서는 안 된다는 점을 분명히 하고 있다. 헌법상의 교육 전문성에서 교육행정은 반드시 일반행정으로부터 독립해야 하는 헌법상의 요청이 있다는 주장도 헌법 구체화법으로 교육기본법이라는 측면으로 보면 설득력이 약하다. 교육자치제도(교육이념실현방식)는 지방자치라는 큰 틀을 한계 범위로서 지방자치가 성공하고 실현되는 범위 내에서 이룩될 수 있는 원초적인 한계를 지니고 있다. 이론적으로 모든 전문분야를 독립하는 것이 적합할 수 있지만, 현재 우리나라의 지방자치의 발전상황과 헌법상 명시된 지방자치의 실현 모습을 본다면, 교육자치제도를 지금처럼 두는 것은 무리가 있다.

In the view of Constitution, the terminology of educational autonomy or local education autonomy, which is open used by scholarly work, has little problem because Korean Constitution never mention educational autonomy. In Korea Constitution, the autonomy was mentioned only in Chapter 8 (local government). Therefore, it is a jump of logic that local educational autonomy is made up with the principle of decentralization, the principle of citizen control and principle of independence of educational administration. According to framework act of education, education shall be operated to perform its functions according to the purpose of the education per se and it shall not be used as a tool for propagating any political, factional or individual biased views. It is logically collect that the educational clause of the Constitution has embodied in law so that Korean Constitution does not require that education system has to be free from policy or political process but must be free from political bias, prejudice, or personal bias. There is also no Constitutional requirement of maintaining educational administration separately from general administration. Constitution requirement is not expertise of educational administration but expertise of education. To make balance with local government system in Korea, this is not right time to focus on local education autonomy. According to FAE, the purpose of education is to enableevery citizen to lead a life worthy of human and to contribute to the development of a democratic country and realization of an ideal of human co-prosperity by ensuring cultivation of character, development of abilities for independent life and necessary qualities as a democratic citizen under the humanitarian ideal. To achieve this goal, it is needed to find right position of education system.
