이 논문의 연구목적은 지방교육 자치제도의 현 실태와 문제점을 고찰하고 그의 개선방안을 제시하는 데 있다. 연구내용은 크게 세 가지이다. 첫째, 교육자치를 보는 관점에 따라 지방교육자치제도의 개선방안 제시에 차이가 있음을 고찰하였다. 둘째, 현행 지방교육자치제도의 구조와 문제점을 밝히기 위해 지방자치단체와 지방교육자치단체간의 구조상의 문제와 권한 배분 상에서 제기되는 문제점들을 분석하였다. 셋째, 교육감 및 교육위원 선출방식에 관한 문제점들을 입후보자의 자격, 선거인단, 선거운동, 교육감 결선투표 및 교육위원직 승계, 선거구 획정, 선거의 시기 등 여섯 가지로 나누어 분석하였다. 이를 위한 연구방법은 일차적으로 문헌연구를 토대로 하였으며, 2002년도에 실시된 전국 교육위원 선거 참여를 통한 관계자들과의 면접, 참여관찰 등의 방법을 사용하였다. 끝으로 연구결과에 대해 여덟 가지의 지방교육자치제도 개선방안을 제시하였다.


The purposes of this article are to investigate real conditions and problems of Local Educational Autonomy System, and to suggest better devices. Study contents are largely divided three. First, According to the point of view about Local Educational Autonomy System, there are differences on the suggestion of its better devices. Second, To investigate the problems of Local Educational Autonomy System, I analyse structural problems and limits of power's problems between Local Autonomy System and Local Educational Autonomy System. Third, The problems of election method of superintendent and educational commissioners are analysed as qualification of candidates, the group of electors, canvassing for votes, revote of superintendent and succession to educational commissioners, allocation of an electoral district, the time of election. Study methods are two type. Primarily, I analysed the relational books on the Local Educational Autonomy System. Secondly, interview and observation method are used to participants who are participated in the election of superintendents and educational commissioners which is held in south korea in 2002. As a conclusion, I suggests eight devices for the better Local Educational Autonomy System.
