본 논문에서는 교육환경권의 개념을 정립하고 법리모색을 바탕으로 교육환경권의 분쟁유형과 판례의 추이와 동향을 고찰하였다. 교육환경권의 분쟁유형을 요약하면 학교보건법상 학교환경 위생정화구역내 금지행위는 7가지 형태로 나타났으며, 학교보건법에서 제외한 주변 교육환경침해 유형은 5가지로 현재까지 나타난 분쟁유형을 모두 종합해 보면 12가지 분쟁유형으로 파악되었다. 이러한 분쟁유형에서 나타난 판례의 추이와 동향 또한 각기 다른 양상을 띠고 있다. 교육환경권인 공익과 사익간의 충돌로 인한 이익교량의 판단은 전적으로 재판부에 달려 있다. 재판부 역시 교육환경권의 보호 판단기준과 이익교량의 형태가 달리 나타나고 있어 양쪽 모두 불만이 속출되고 민원이 끊이지 않고 있는 실정이다. 그러므로 사안이 발생할 때마다 학교보건법 제6조 제1항의 각호를 수정 변경하는 형태를 언제까지 할 수 없는 것이다. 학교내부로서의 환경권을 최소한의 보호할 수 있는 준거규정과 학교주변 교육환경권과 교육시설에 대한 일조권․조망권의 판례의 혼선을 막을 최소한의 준거규정, 그리고 고압송전선로 설치시 지상 및 지하 거리규정 등 마련이 시급하며, 또한, 산재하고 하고 있는 적용법규들과 법규미비로 판례 혼선 등을 하나로 통합하는 법규마련이 절실하다고 할 것이다. 비록 늦었지만 학교보건법을 통합한 형태의 교육환경권을 보호하는 기본적인 적용기준을 제시하여 다툼의 소지를 미연에 방지할 수 있는 가칭『교육환경기본법』을 별도로 제정하는 것이야말로 이 시대적 소산이라고 본다.
Recently, the importance of the Education Environmental Rights is becoming the main issue of schools. And a school trouble surrounding the Education Environmental Rights is increasing. This article organizes the concept of the Education Environmental Rights and the theory of the law. And based on the theory of the law, it is explored a sort of disputes over the Education Environmental Rights and changing process of precedent. A sort of disputes over the Education Environmental Rights is placed on seven different ways in the School Health Law. A sort of infringement about the surrounding educational environment except for the School Health Law has five ways. So, all the take together it has 12 different ways of a sort of disputes. In these kinds of conflicts, changing process of precedent is different by cases. The judgement due to a conflict between the public interests and personal gains that is called the Education Environmental Rights is entirely up to the court. It has complaints on both sides, because in the court, the criteria protecting the Education Environmental Rights is also changeable by cases. Therefore, from now on it is necessary to enact tentatively named 『The Fundamentals of Education Environment Act』separately which is able to head off the conflict by suggesting a fundamental standards of application protecting the Education Environmental Rights integrated the School Health Law.
