방송·통신기술의 계속적인 혁신과 방송의 글로벌화가 진행되면서 방송산업을 둘러싼 환경이 극적으로 변화하는 이 시점에서 방통융합시대의 방송과 저작권의 문제를 검토하는 것은 의미가 있다. 따라서 본고에서는 방송통신 기술의 발전으로 방송의 대중미디어로서의 공적 성격이 변화하고 있는 점, 과거 방송자원의 희소성에 의거한 논리들이 들어맞지 않게 되어 이제 새로운 관점에서 접근을 요구하고 있다는 점, 방송 저작물도 기존 방송에 국한되지 않고 방송과 통신이 융합된 새로운 공중전달방식에 의하여 전달될 수밖에 없는바, 방송의 개념이 확장되고, 더 나아가 방송 개념이 공중전달에 포섭되어 글로벌화하는 변화를 반영하여 새로운 방송권인 공중송신권의 개념을 정립해야 하는 점, 저작권 집중관리기구의 육성이 필요한 점, 방송저작권의 국제적 보호를 위한 노력을 기울이고 방송의 저작권자로서의 지위를 강화하도록 하는 점 등이 앞으로의 방송저작권의 새로운 파라다임의 변화 방향임을 지적하였다. 이와 관련하여 국내의 저작권법 등 법 제도의 개선과 정책적 논의가 필요함을 강조 하였다.
