이 글은 국민체육진흥법의 개정방향의 구체적인 내용을 다룬 논문이라기 보다, 현재 대한체육회에서 논의되고 있는 정관개정을 통한 대한체육회와 대한올림픽위원회의 통합의 문제점을 지적하고, 국민체육진흥법을 우선적으로 개정하는 것이 필요하다는 것을 역설하고자 함에 있다. 대한체육회(KSC)와 대한올림픽위원회(Korean Olympic Committee, 약칭 KOC)의 관계를 어떻게 정립할 것인가의 문제는 체육단체의 조직개편의 문제로서 매우 중요한 문제에 속한다. 대한올림픽위원회는 그동안 대한체육회내의 특별위원회의 형식으로 되어 있는바, 이를 분리하여 독자적 조직으로 발전해 나가는 것이 바람직 한 것인지, 아니면 양 단체간의 통합을 실현하는 것이 바람직한 것인지에 관하여 2002년부터 체육계내에서 논란이 계속되어 왔다. 국민체육진흥법에는 대한체육회와 대한올림픽위원회라는 2개의 체육단체를 전제하고 있는데 법률개정이 선행되어야 하며, 이를 통하여 광범위한 국민적 의견수렴 절차를 거치게 되고, 대한체육회 정관개정만으로 양 단체를 기계적으로 통합할 경우에 절차상의 문제가 제기될 수 있다. 대한체육회는 정부의 감독을 받는 기구인데 반하여 대한올림픽위원회는 국제올림픽위원회의 국가지부로서 정치적, 법적 독립성과 자율성을 특징으로 하고 있어, 한 단체로 통합되어 상이한 2가지 기능을 수행하는 경우에 법리적인 관점에서 문제가 제기 될 수 있다. 대한체육회와 대한올림픽위원회가 단순한 기구의 통합이냐 분리냐라는 차원을 넘어 왜 조직개편을 하여야 하는지, 어떤 절차를 거쳐서 통합하는 것이 법치의 이념이 맞는지 등에 대한 명확한 인식이 선행될 필요가 있다. 대한체육회와 KOC의 통합은 통합의 시발점이 됨과 아울러 대한체육회를 국가올림픽위원회(NOC)의 체재로 개편하여 NOC중심의 대통합이 적법절차에 따라 추진되기를 기대한다.


This is not a paper studying in depth ways to amend the National Sports Promotion Act, but simply intends to point out probable problems in the currently discussed amendment of articles of incorporation for integrating the Korea Sports Council and the Korea Olympic Committee and to highlight the necessity to primarily amend the National Sports Promotion Act. Establishment of relationship between the Korea Sports Council (KSC) and the Korea Olympic Committee (KOC) is a very important issue as it greatly influences reorganization of a number of affiliated bodies throughout the nation. The Korea Olympic Committee has existed as a special committee in the Korea Sports Council till now. Since the year of 2002, however, debates have been made incessantly and widely throughout the nation's sports circle on which would be more desirable, separation as independent organizations or existence as an integrated organization. Beforehand, the National Sports Promotion Act should be amended, as it assumes the two different organization of the Korea Sports Council and the Korea Olympic Committee. And then, public opinions should be widely collected throughout the nation. A physical integration of those two organizations only through amendment of articles of incorporation may result in a lot of procedural controversy. While the Korea Sports Council is under the supervision of the government authorities concerned, the Korea Olympic Committee is just one of branches of the International Olympic Committee (IOC) and has political and legal independence and autonomy. Accordingly, integration of the two organizations performing different functions may cause lots of legal problems. Integration of the Korea Sports Council and the Korea Olympic Committee is not a simple issue limited to reorganization of different bodies, but absolutely requires definite prior understanding and consensus on reasonable causes, procedures and legal principles. Accordingly, considering that integration of the KSC and the KOC is not only the starting point of integration of other sports bodies throughout the nation but also changes the KSC to the National Olympic Committee (NOC) system, their integration is required to be proceeded in accordance with legal procedures on the basis of national consensus.
