학교체육 활성화는 체육이라는 특정 교과목을 지키자는 차원을 넘어서서 지-덕-체의 균형과 조화를 이루기 위한 교육의 본질을 되살리는 일이다. 그러나 우리의 학교체육은 입시위주의 교육환경 속에서 점차 실종되어 가고 있고, 우리의 학교운동부는 후진적인 환경과 관행 하에 학생선수들의 학습권과 인권의 사각지대로 변질되고 있는 것이 우리의 냉엄한 현실이다. 「학교체육법」의 제정은 이러한 문제의 해결을 위하여 반드시 이루어내야 할 큰 과업이다. 동법은 우리의 어린 학생들, 젊은 학생들의 건강과 인권의 유지・보존을 위한 중요한 법제도적 기반이 된다. 이 논문은 이미 국회에 제출되어 있는 「안민석」의원안(「학교체육법」안)과 이에 대한 교육과학기술부의 검토의견 및 그 둘 모두에 대한 필자의 분석을 중심으로 서술되어 있다. 그리고 안민석 의원안과 교육과학기술부의 검토의견에 빠져 있는 중요한 부분도 첨가하여 검토하고 있다.


The revitalization of the sports in school is to revive the essence of education for the balance and harmony of intellectual training, moral training and physical training beyond the dimension of defending that subject "physical education". But our sports in school have been missing gradually amidst the educational environment which makes entrance exam for advanced schools the prime object, and our athletic clubs in school are deteriorating into blind sports of the rights for learning and human rights of student players. The making of 「The sports in school Act」is a great task which must be accomplished for the solution of these problems. 「The sports in school Act」 will be the legal basis for the maintenance and preservation of young student's health and human rights. This study aims to analyze 「The sports in school Act」 bill which was presented by the representative, Min-Seok Ahn and the response to the bill by the Ministry of Education, Science and Technology, and afterward will add some important issues about the sports in school to the bill.
