2011년 「말산업 육성법」 제정과 함께 주 5일제 정착 및 건강에 대한 관심과 욕구 증대로 인해 여가활동으로서 레저승마활동에 참여하는 사람들이 증가추세에 있다. 이를 대변해 주듯이 국가경제산업으로서 파급효과를 가지고 있는 말산업 활성화를 위해 정부는 법률적 근거를 토대로 말의 생산, 사육, 조련, 유통, 이용 등, 레저승마 활동의 안전과 질서를 확보하고 말산업의 발전을 도모하며, 레저승마 대중화를 위해 보다 체계적이고 효율적인 제도와 정책을 마련하고 있다. 이러한 관점에서 정부와 지자체는 말산업 활성화와 관련 산업 진흥을 위하여 중ㆍ장기 적으로 ‘말산업 특구’ 지정과 “말산업 육성 5개년 종합계획” 등, 인프라 구축 사업과 함께 다양한 육성방안을 추진하고 있지만, 「말산업 육성법」과 “말산업 특구”를 지정하는 과정에서 안전에 대한 가치를 기반으로 활성화시키는 규정은 유지되어 왔으나 말산업 육성 정책이 성과를 거두기 위해서는 불필요한 규제개선과 승마 수요활성화 정책이 필요하다는 목소리가 제기되고 있다. 또한 「말산업 육성법」에 의해 만들어진 대부분의 농어촌형 승마시설은 열악한 경영실태로 인하여 미신고 승마장, 전문인력 미배치, 보험 미가입 등, 운영에 있어서 불법ㆍ탈법영업 및 타 법령과 마찰되는 여러 사례가 있었으며, 안전사고에 의한 제도장치 보완의 필요성과 보험체계가 미흡함에 따라 개선방안이 시급한 것으로 나타났다. 아울러 대다수의 승마시설이 분뇨처리 및 위생관리에 대한 인력부족으로 인해 많은 어려움을 겪고 있기에 효율적인 경영활성화를 위해서 한국마사회 등의 전문인력 양성기관을 통한 순환식 전문 인력을 배출하는 지원방안이 필요하다. 이에 본 연구에서는 레저승마의 대중화 및 활성화를 위해 시대적 요구를 보다 적극적으로 수용할 수 있는 합리적 방안으로의 개선이 요구되고 있기에, 주요 동법 고찰을 통하여 현장에서 제기되는 문제점을 분석하고 개선 방안을 제시함으로써 레저승마 활성화와 관련 산업 발전에 기여하고자한다.
As 「Horse Industry Promotion Act」was established in 2011, 5-day work-week system was settled and the interest in and desire about health increased, gradually more and more people are participating in the leisure horse riding activity as a leisure activity. In order to activate the horse industry that has a ripple effect as a national economic industry, the government has established the safety and order of leisure horse riding industry such as production, breeding, training, distribution and usage of horse on the legal basis, has searched for the development of horse industry and has established systematic, effective system and policy for popular leisure horse riding. With this viewpoint, the government and local autonomy have promoted various nurturing methods by appointing the special area for horse industry, promoting 5-year plan for horse industry nurturing and constructing infrastructure in order to promote the industry related to the activation of horse industry as a long- and mid-term plan. Although the regulation to activate the industry based on the value of safety in the process to nurture horse industry and appoint special area for horse industry, there is a voice that unnecessary regulation should be improved and the policy to activate the need of horse riding is required. As the revision is required as the reasonable method to adopt the current request more actively for popular, activated leisure horse riding, the study analyzed the main issues of the law proposed in the field and considered the improvement method to contribute to the activation of leisure horse riding and the development of related industry.
