이번 고(故) 김병찬 선수 사건을 통해 현재 국위선양을 위해 노력한 체육인들에 대한 복지 혜택을 비롯한 사회보장이 충분하지 않다는 것이 문제점으로 제기되고 있다. 그 조차도 국가대표로서국제대회에서 입상한 극소수의 선수들에게 혜택이 집중되어 나머지 대다수의 선수들은 개인적 역량에 의존하는 수밖에 없는 상황이다. 이에 많은 체육인들이 2012년에 발의된 체육인복지법의 조속한 통과를 바라고 있는 실정이다. 체육인복지법의 제정에 앞서 기존의 「국민체육진흥법」, 「체육시설법」및 「생활체육진흥법」의 개정과 제정 또한 기존에 체육계의 사각지대에 있던 분야에 복지 혜택을 부여하고, 생활체육활성화를 통해 국민의 건강과 삶의 질을 높이고 스포츠산업의 활성화를 이루고자 하였다. 그러한 취지에서 2010년 설립된 스포츠안전재단은 생활체육단체의 활동을 중심으로 공제계약을 제공하여 생활체육영역에 경제적 안전망을 구축한 것에 의의가 있다. 그러나 스포츠안전재단은 설립에관한 법적근거가 미비하고, 운영, 감독 및 취급하는 공제상품에 대한 규제도 없는 실정이다. 또한재단의 공제상품은 그 성격이 모호하여 재보험계약 또는 중개계약에 관한 「보험업법」규정을 위반하고 있는 것으로 보인다. 앞서 언급한 각 법률의 목적과 의무규정의 합치, 체육인의 사회보장망 구축, 생활체육의 활성화라는 목적에 부합하기 위해서는 체육인공제회의 설립, 운영, 영업 및 청산에 이르는 자세한 규정을체육인복지법(안)에 추가하거나, 체육인공제회법을 별도 입법하여 구체적이고 정밀한 법체계를 구축할 필요가 있다.

Add to the social security network built for athletes, for the purpose of activating the sport for all establishment of the athletes Mutual Aid Association, operation and regulation leading to more sales and liquidation of athletes Welfare Act (draft), or athletes Mutual Aid Association Law with separate legislation specifically for athletes and precise there is a need to build a legal system.
