이 연구는 동반자살에 의한 자동차사고가 발생한 경우 이제껏 보험금의 청구 및 지급사례가 없었던 점에 주목하여 동승피해자의 상속인은 보험자에게 자배책보험금을 청구할 수 있으며 이에 대하여 보험자는 보험금지급의무가 있는 것인지에 관한 연구이다. 연구의 결과 동승피해자의 상속인은 보험자에게 자배책보험금을 청구할 수 있고 이에 대하여 보험자에게는 보험금 지급의무가 있다는 결론을 도출하였다. 아울러 후속대책으로 사고를 조사한 관할경찰서장에게 피해자청구를 고지하도록 하는 입법조치를 취할 필요가 있음을 제기하였다.
Considering that there is no case of request and payment for a claims paid related to the car accidents by family suicide, this study is on whether a beneficiary of the riding victim can make a request for claims paid of automobile liability insurance and the insurer has an obligation to pay the claims paid. According to the victim can make a demand for claims paid and the insurer is subject to have a responsibility to pay it. In addition, follow-up legal measures are needed to notify superintendent of a police station to notify victim`s claims.
