공익사업의 시행과 관련하여 손실보상에 대한 법적 분쟁이 빈번하게 발생하고 그에 따른 사회적 비용과 혼란이 점점 커지고 있다. 이러한 현상이 발생하는 이유는 현재의 손실보상에 대한 이론적 연구와 이를 근거로 한 실정법상의 제도가 현실을 반영하지 못하고 있기 때문이라고 생각된다. 작년에 큰 사회적 이슈가 되었던 상가 임차권자의 권리금보상의 문제만 보아도 그러하다. 현행 손실보상제도에 대해서는 이러한 권리금보상의 문제뿐만 아니라 보다 명확한 개념정립을 위한 이론적 연구와 법제도의 개선이 필요한 부분이 아직도 많은데 그 중 하나가 생활보상의 문제이다. 손실보상분야에서 아직까지 정리가 되지 않은 중요한 문제 중의 하나로 그 보상의 필요성에 관하여는 일반적으로 견해가 일치하고 있고, 현행 손실보상 관련 법률도 명시적으로 ‘생활보상’이라는 규정을 두고 있지는 않으나 학설이 주장하는 생활보상에 해당하는 규정들을 두고 있다. 하지만 이러한 규정들이 현실의 공익사업과 관련하여 발생하는 손실을 충분히 보상하는지의 여부와 각 개별 법률들이 생활보상을 조화롭게 체계적으로 규정하고 있는지에 관하여는 여전히 문제가 있어 보인다. 이는 아마도 아직까지 생활보상의 개념과 그 범위에 대한 이론적인 충분한 연구가 이루어지지 않아 이를 입법에 충분히 반영하지 못한 결과이기 때문이다. 이런 이유로 법상 인정되는 생활보상의 내용이 제한적이어서 법률상의 요건을 충족하지 못한다거나, 개별 법률마다 인정하는 생활보상이 달라서 국민의 입장에서 볼 때 형평성의 문제와 생활보상에 대한 체계상의 혼란을 가져온 현상이 발생한다. 이러한 점에서 생활보상의 개념정리와 법적 근거, 현행법상의 생활보상의 구체적 내용에 대한 법적 검토가 요구된다. 특히 외국의 입법례를 통해서 현행 우리나라 생활보상의 내용상의 문제점을 논의하고 그에 대한 개선방향을 제시하고자 한다.

Recently legal disputes occur frequently respect to compensation for losses with execution of public works. Also, the resulting in social impact is getting bigger and bigger, current situation is more serious. The reason for current situation is the theoretical research of compensation and legal system is not reflect reality. The current Compensation system is need the theoretical research and improvement of the legal system for just compensation, One of the these is compensation for livelihood compensation. Livelihood compensation is one recently discussed important issues. About the necessity of the compensation is generally consistent with the views and relevant laws and regulations have been about the livelihood compensation. However, the provisions is not enough to full compensation for execution public works service in many parts. Theoretical studies about the concept and scope for livelihood compensation is not sufficient. For this reason legislation has failed to reflect sufficiently. Because of the scope and requirements of livelihood compensation are limited recognized by law, the victim is not compensated enough. In this regard, theoretical review is required to the concept and content, limit of compensation for livelihood compensation, and improvement is required. This paper research on South Korea's Compensation for living rights and other country's livelihood compensation, such as UK, USA, Germany and Japan, to improve our system by way of legal compared.
