국제기구의 공식적 기후변화에 관한 보고서가 있다고 하더라도, 인간지적능력의 한계와 과학기술의 한계 때문에 불확실성이 존재하지 않는다고 단언할 수 없지만, 기후변화문제는 인간의 삶의 질과 경제적 발전 그리고 인류의 존속문제까지 지대한 영향을 미칠 수 있으므로 절대적 확실성이 보장되어야만 대책을 마련해야 하는 문제는 아니다. 또한 규범학인 법학은 불확정의 영역에 대한 진입을 회피하는 경향이 있으나, 정책수립이 사실학인 행정학과 정치학의 배타적 영역이 아니라 현대 국가에서는 사실판단과 정책수립은 당연히 법학의 영역도 속한다. 기후변화대응법제에서 고려할 사항중에 중요한 요소는 환경정의이다. 환경정의는 무수한 사회정의 중에서 환경분야에서 실현되는 정의이다. 환경정의와 헌법상의 원칙들은 “인간의 존엄과 가치” 그리고 “행복추구”라는 동일한 방향으로 귀결될 수 있으므로 현재의 헌법해석과 기본원리와 정합성(integrate)을 이룬다. 환경정의는 오염자부담의 원칙의 실질적 실현을 추구하기에 환경법상의 기본원칙과 조화를 이룰 수 있다. 온실가스저감의 방안 중 하나인 배출권거래제의 도입을 위해서는 정확한 총배출량산출과 공정한 허용량의 배분 그리고 배출량의 측정·보고·검증의 체계가 이루어져야 한다. 물론, 온실가스의 경우 배출량을 전기사용량, 연료사용량 등 다른 수단을 통해 간접적으로나마 거의 공평한 추정을 할 수 있다. 하지만 배출거래제의 기초인 배출총량을 결정하는 것은 쉽지 않은 작업이다. 또한 이것을 측정ㆍ보고ㆍ검증하는 것은 더 어려운 면이 있다. 우리의 법체계와 실무계에서 감당할 수 있는 제도를 설계해야 하며, 그 것의 공정성과 투명성이 담보되는 제도가 녹색성장기본법과 배출권거래제법에 추가되어야 할 것이다. 제도운영과 여기서 파생되는 비용은 최소화하는 방향으로 제도가 설계되어야 한다. 배출제한과 거래제도입이 또 다른 노다지로서 환경보호와 직접 관련 없는 금융업, 보험업, 유사전문가, 법률가, 기타 기업체의 이윤확대의 수단이 되어서는 안 될 것이다. 유럽의 배출권제도를 사기꾼의 천국으로 비하하는 예도 있다는 것을 잊어서는 안 된다.

There are official IPPC reports on Climate change but there are still scientists debate whether human-induced climate change is pushing natural variability to the extreme or whether global warming has real scientific certainty. Legal science or law professor should involve in policy and law making process of climate change legal framework. Legal framework for climate change must include the other related notion such as environmental justice. However the low-carbon green growth Act or other related law have not embrace the idea of social justice and balanced development between local governments. Korean government should consider unbalanced developments between local and the capital area when she designed the emissions trading system. Local governments are in several distinct positions such as polluter, policy maker, policy keeper and local governments. To accomplish these green growth, balanced development and social justice, there must be redistribution government power between central government and local government from making rules and regulation to imposing taxes as well as reform of national and local tax system. The global warming caused by GHG has emerged as a global environmental problem. For this reason the continued efforts to reduce GHG emission by international cooperation and each country are in progress. This study was performed for a successful accomplishment of Korea’s ETS aims in 2015, that is to reduce GHG emission, maintain competitiveness of the domestic industries and to reinforce competitiveness of the environmental management of domestic companies through comparing analysis.
