다단계 금융사기는 유사수신행위나 방문판매 등을 이용해 합법을 가장한 불법을 통해 이루어지고 있으며, 조기에 많은 금액을 유치하기 위해 다단계 방법을 사용하므로 인해 문제 발생 시 많은 피해자와 피해금액이 발생하는 것으로 사회를 좀먹는 사회악적인 범죄임에 틀림없다. 이러한 범죄가 발생하는 이유는 고수익 미끼를 사용하고, 경제관념이 부족하며, 남의 말을 쉽게 믿는 성향의 소유자, 낮은 처벌 등으로 발행하고 있다. 이를 방지하기 위해서는 첫째, 다단계 금융사기는 대개 금융기관을 통해 이루어지고 있으므로 일정금액이 입·출금되는 행위가 일정기간 지속되면 은행 전산으로 나타나게 하는 프로그램을 통해 감독기관에서 확인하고, 문제가 있을 경우 바로 수사기관에 통보하여 처리될 수 있도록 해야 한다. 둘째, 다단계 금융사기는 대개 신고를 꺼려하고 있으므로 이를 방지하기 위해서는 내·외부 신고포상제도를 운영하여 조기에 신고를 통해 피해확산을 막아야 한다. 셋째, 처벌에 있어 피해금액과 피해자들의 고통에 비해 너무나 낮은 처벌이 이루어지고 있으므로 양형기준을 통해 합리적인 처벌이 이루어져야 또 다시 덫을 놓고 기다리는 형태가 발생하지 않을 것이다. 넷째, 투자로 인해 수익금과 각종 수당에 대해 부당이득으로 간주하여 반환규정을 만들어 반환하게 하여 반환된 금액 중 일부를 피해자게에 돌려주어 피해회복이 될 수 있도록 해야 한다.
Multi-level financial fraud has not been eradicated but continues to happen. Once this happens, many people have damage with much financial loss. Let’s see prevention of damage from multi-level financial fraud and recovery solution. First, Multi-level financial fraud is made through transaction with a bank. So if a certain amount is repeatedly paid and withdrawn through bank account for some time, it is necessary to manage and such transaction with bank should appear on program. Second, As present sentence is too light, suspended sentence or monetary penalty should be restrained by considering legal sentiment. At least it is necessary for them to be confined to jail. Third, In general, crime is committed by introducer. So it is necessary to make a law to collect alliance for introduction or sponsor alliance, profit for introducer by whole amount as undue profit - the amount should be paid back to person with damage.
