본 연구는 장애인 차별금지정책이 입법화 과정에 대한 정책형성 및 결정과정에 대한 분석이다. 본 연구는 1975년 유엔의 장애인 권리선언과 1981년 세계장애인의 해 등 장애인 차별금지에 영향을 준 세계적인 장애인 인권운동을 기점으로 한국에서 2008년 4월 11일부터 장애인 차별금지 법률이 발효될 때까지의 과정을 드롤(Dror)의 정책분석모형을 기초로 분석 한 결과이다. 각종 언론 보도를 통해서는 정책 형성과 결정 담당자들의 자세와 행동을, 선행연구를 통해서는 정책형성과 결정의 목적과 내용을, 각종 통계자료를 통해서는 정책형성과 결정 과정 시기의 적절성을, 관보나 국회회의록을 통해서는 차별금지 정책결정 과정을 살펴 보았다. 그 결과 한국의 장애인 차별금지정책은 적절한 시기에 적절한 절차를 거쳐 입법화되었으나 정책 결정과정에서 입법담당자들의 타율성이 크고, 향후 관련법들과의 관계, 상충되는 부분들을 고려하여 추가적인 수정이나 논의가 필요 한 것으로 나타났다.


This study is an analysis on the shaping and decision process of the legislation of the disability non-discrimination policy. Considering the special nature of the subject matter, we have discussed the necessity of laws regarding disability non-discrimination and redemption of rights based on Dror's policy analysis model. The analysis was done the attitude and behaviour of the policy shaping and decision makers by various mass media reports, objectives and contents of the policy shaping and decisions by previous research, appropriateness of policy shaping and decision process time by various statistic materials, non-discrimination policy decision process by government newsletters or stenographic records of the National Assembly of the Republic of Korea. The result indicates that the legislation of the disability non-discrimination policy in Korea was well-timed, however, the legislators showed a high level of heteronomy, and further amendment or discussion is needed concerning possible conflicts with related laws in the future.
