이 글의 목적은 농업인들의 농업 활동을 통해서 만들어진 보다 나은 환경의 혜택을 입은 비농업인이 환경개선비용을 부담해야 하는 의무를 가진다고 주장하는 것이다. 이 주장을 위해 우선 환경세 및 환경부담금이 부과되는 기존의 원칙을 검토하고, 응능원칙이나 응익원칙이 해결할 수 없는 새로운 문제로서 비농업인의 무임승차 문제를 제시한다. 비농업인의 무임승차 문제란 농업인들의 활동을 통해서 더 나은 환경의 혜택을 입은 비농업인이 환경개선 부담금을 납부하지 않으면 무임승차의 소지가 있다는 것이다. 이 문제에 대한 보다 더 자세한 논의를 위해 그 문제의 본질을 규명한 후, 공정원리의 기본 아이디어를 소개하고 그 원리를 통해서 비농업인 무임승차 문제의 해결을 시도한다. 이 때 제기될 수 있는 몇 가지 조건 및 비판을 논의한다.
The purpose of this paper is to argue that non-farmers have a duty to pay environmental charges in return for their benefit from a better environment made by agricultural activities of farmers. For this argument, this paper examines the current principles for environmental tax and charges, and suggests that both the ability-to-pay principle and the benefit principle cannot solve a new problem, that is, the problem of non-farmers’ free-riding, according to which non-farmers who benefit from a better environment made by farmers are likely to free-ride if they do not pay the environmental charge. Having analysed the nature of the problem, this paper introduces the basic idea of the principle of fairness, with which it tries to solve the problem of non-farmers’ free-riding. It also discusses some conditions and criticisms that may arise during the argument.
