이 논문은 외국의 동물권이론 및 국내 철학자들의 동물실험에 대한 글을 중심으로 동물실험에 대한 윤리적 논의를 살펴본다. 추정완등은 구명선의 이론으로 동물실험의 정당성을 설명하고 있으며, 김명식은 심의민주주의제도로서의 동물실험에 대해서 살펴보고 있는데, 이들의 논의가 인간중심주의 윤리의 성격을 보이고 있다. 구체적으로, ‘구명선’의 논리에 의해서 동물실험의 윤리성을 바라보는 것은 한계가 있다. 또 계약주의 도덕이론에 의해서 실험동물에게 도덕적 지위가 주어지지 않는 것은 그 이론의 한계로 보아지나, 심의민주주의적인 원리는 동물실험에 대한 사회윤리를 발전시키는데 도움이 되리라 본다.
This paper reviews the major writings on laboratory animal ethics. A paper justifies animal experiments by comparing the animal experiment to life boat situation. Also another paper explores the laboratory animal ethics from the perspective of deliberate democracy. Specifically, animal experiment as ‘life boat’ is limited metaphor of real animal experiment situation. Contractarian moral theory has limitations as it denies the moral status of the laboratory animals. However, the principles of deliberate democracy would contribute to develop social ethics on animal experiments. These major ethical views are reflected on the new Korean lab animal experiment law as it does not consider ethical consideration of laboratory animals.
