본 연구에서는 세 가지 위원회 이론의 관점에서 18대 국회 세 개 상임위원회에서 논의된주요 법률안의 심사과정에 대한 심층적인 사례 분석을 시도한다. 위원회 배정과 활동에 관한상이한 논리적 관점을 제공하는 위원회 이론을 활용하여 상임위원회의 입법과정의 다양한 특징을 이해할 수 있을 것으로 기대된다. 먼저 위원회를 재선지향적 위원회로 간주하는 이익분배이론의 관점에서 보건복지위원회에서 다루어진 약사법개정안의 심사과정을 분석한다. 둘째,위원회를 정책지향적 위원회로 간주하는 정보확산 이론의 관점에서 외교통상통일위원회에서다루어진 국제개발협력기본법률안 제정 사례를 분석한다. 셋째, 위원회를 정당지향적 위원회로 간주하는 정당이익론의 관점에서 농림수산식품위원회에서 다루어진 농업협동조합법개정안사례를 분석한다. 이들 세 가지 법률안의 상임위원회 심사과정에 대해 법률안 제 ‧ 개정안의발의 취지 및 현황, 심사과정에서의 주요 쟁점, 처리결과 등을 중심으로 내용분석을 실시하였다. 분석 결과, 각각 사례의 경우에 이들 세 가지 위원회 이론의 관점에서 법률안 심사과정의특징이 잘 설명될 수 있다는 점이 드러나고 있다. 다만 법률안 심사과정은 단일의 이론적 시각이 배타적으로 적용되기보다는 상호 중첩적으로 적용될 때 보다 높은 설명력을 지닌 것으로나타나고 있다.
This study attempts an in-depth case analysis of the consideration processof main legislative bills discussed at three standing committees of the 18thNational Assembly from a perspective of three theories of committee. Thisstudy is expected to provide understanding of various characteristics of legislationprocess at the standing committee using the theory of committee that offersdifferent logical viewpoints on allocation and activity of committee. From theviewpoint of distributive theory that regards a committee as a reelection-orientedcommittee, this study first analyzes consideration process revised bill of thePharmaceutical Affairs Law which was handled at the Health and WelfareCommittee. Second, this study analyzes an example of enactment of the FrameworkAct on International Development and Cooperation dealt with at the ForeignAffairs, Trade and Unification Committee from the viewpoint of the informationaltheory that regards a committee as a policy-oriented committee. Third, fromthe perspective of partisan theory that regards a committee as a party-orientedcommittee, this study makes an analysis on the example of revised bill of theAgricultural Cooperatives Act handled at the Food, Agriculture, Forestry andFisheries Committee. This study carried out a content analysis of considerationprocess of the above three legislative bills at the standing committee focusingon the intent of proposal of enactment ‧ revised bills, current status, main issue and result of treatment at the consideration process. As results of contents analysis,this study revealed that in each case, characteristics of consideration process of legislative bills can be well explained from the viewpoints of those threetheories of committee. As for the consideration process of legislative bills, however,overlapped application of theories can guarantee higher explanation power ascompared to the exclusive application of a unitary theoretical viewpoint.
