박근혜 정부에 들어 규제개혁은 매우 중요한 국정과제로 간주되고 있다. 현 정부는 대통령이 직접 규제개혁 장관회의를 주제하고 마라톤회의를 통해 규제개혁 대상 사안을 발굴하는 등 강한 개혁 의지를 천명하면서 실천을 위해 노력해 왔다. 지방규제개혁의 경우도 예외가 아니다. 현 정부에서 지방규제개혁은 “지방자치단체가 경쟁적으로 규제를 개혁하도록”한다는 대통령의 의지와 이를 구현하려는 행정자치부의 노력으로 추진되고 있다. 현재 지방규제개혁은 i)상위법령과 불일치하는 조례나 규칙 등의 발굴 및 철폐, ii)법령에 근거 없는 자치규제의 발굴 및 철폐, iii)담당 공무원의 행태 개선 등에 초점을 맞추고 있다. 그러나 현재 추진되는 방식의 지방규제개혁은 그 효과가 일부 인정되고 있음에도 불구하고 규제개혁의 기본원리 구현과는 거리가 있는 것으로 보인다. 무엇보다도 규제개혁의 근본적인 목적인 경제규제 완화 또는 철폐를 통한 지역 경제 활성화 실현에 많은 한계를 노정하고 있다. 현 정부가 추진하는 ‘경쟁’은 이해하기에 따라서는 행정자치부가 제시하는 기준을 달성하기 위한 “지시형 경쟁”에 머물고 있으며 그 결과는 상당 부분 경제 체질 개선과는 거리가 멀 수 있다. 이런 의미에서 향후 지방규제의 “경쟁적 개혁”은 지방자치단체가 자발적으로 지역발전이 가능한 산업을 발굴하고 추진하며, 그 걸림돌이 되는 규제를 우선적이고 집중적으로 발굴하고 철폐하여 규제개혁이 지역 고용 증가와 인구 유입, 소득 증가 효과를 발생시켜 선순환 할 수 있도록 하는 것이 중요하다. 특히, 근본적인 규제개혁 체계 구조개혁을 추진하여 규제개혁이 지속적이고 일관성 있게 추진되도록 개선되는 것이 바람직한 것으로 보인다

Regulation reform is one of the most important policy agenda of the Park Geun-hye administration. President Park gives a strong emphasis on the implementation of regulatory reform by hosting Minister’s Meeting on Regulatory Reform. In fact, some regulations to be eliminated are discovered and enforced to be abolished during the consecutive meetings. Local governments regulations are not an exception. Local regulations reform is undergoing by the Ministry of Government Administration and Home Affairs under the title of “Let the local government can reform regulations competitively.” It gives emphasis on the problem solving such as i)finding and abolishing local ordinances or local by-laws which are violating laws and ministerial decrees, ii)finding and abolishing local ordinances or local by-laws which are not based on the laws or ministerial decrees, iii)reform the attitudes and behavioral practices embedded in the regulatory bodies. Even though it shows some positive results, local governments regulations reform seems that it does not actualize the original principle of regulatory reform that orienting economic revival of local area. The “competition between local governments” undergoing by the Ministry of Government Administration and Home Affairs became a “goal oriented directive competition” which is far from ensuring and increasing economic competitiveness. In this sense, “competition between local governments” needs to be guided to a “voluntary regulation reform competition” in accordance with each local governments industrial conditions. Voluntary regulation reform can yield a ‘virtuous circle’ consist of intensive regulation reform on strategical industrial area, high rate of employment, growth of population in local area, and income increase. To achieve it, rehabilitation on local governments regulation reform system needs to be done relentlessly.
